Hi there,

I filed my VAWA (al by myself without lawyer because I had less than $20 to my name) day after Memorial Day US. I got my first letter saying it was received two weeks later. About 10 days later I got letter sayig that my application does not meet VAWA qualification however they ask for good moral conduct in requestfor evidence. Is this a denial? If they say does not meet VAWA why ask for mymoral conduct? I have a clearance from when i had to go in Salvation Army for being homeless after he had me evicted and apolice record from my home country.

I sent in my package: four police reports (false imprisonment stalking and sex crime against my child all have witnesses interviewed from the police), his bond which include no contact with me, passport pages all of us, a letter i wrote the court nd oour marriage documents and vowsand mail and lease and car insurance with our names on it. i wonder if i should now put photos, copies o appointment to the crisis center,affadavits from friends who know of the abuse and a cd of him verbally abusing meand emails from him saying he will get my documets i stay with him.ButI am afraid why they want informatin wth request for evidence if they said what they said. I have no problem with my record. I dn't even have a car accident on my record. Any idea? Anyone recieved that letter? My little girl andI have been through a lot. I thought I could take him verbally and once in a while physially abusing me but when my littl girl said whathappened to her that was enough for me. she is not his child.

if he has abused your daughter, you need to get out of there and if you haven't already, report him to the police. go to the local women's shelter and they can help you with legal assistance.

This is not good. They usually would not ask for evidence of good moral character unless they already had evidence that you did not meet the definition of a person with good moral character, and that you had committed or been convicted of an act described in section 101(f) of the INA. When they've made this determination they are supposed to ask you for evidence to determine whether you are eligible to have the offense waived, and then they make a discretionary determination whether to waive the offense. It's important to understand that there are some offenses that would not make you deportable, but would disqualify you as a person of good moral character, including being a habitual drunk, making a living primarily from gambling, giving false testimony, etc.

It's clear that they've made this determination because you've said they stated your application "doesn't meet VAWA qualificaton". That's a pretty clear sign they've found something that makes you ineligible.

I strongly suggest you get a good immigration lawyer immediately. You need to find out what derogatory information they have on you, and respond to it.

This is not good. They usually would not ask for evidence of good moral character unless they already had evidence that you did not meet the definition of a person with good moral character, and that you had committed or been convicted of an act described in section 101(f) of the INA. When they've made this determination they are supposed to ask you for evidence to determine whether you are eligible to have the offense waived, and then they make a discretionary determination whether to waive the offense. It's important to understand that there are some offenses that would not make you deportable, but would disqualify you as a person of good moral character, including being a habitual drunk, making a living primarily from gambling, giving false testimony, etc.

I tried to get an immigration lawyer but they ask for $1500 that I do not have. Anotheraked for deposit of $750. And I heard that he threatened to call them to warn me that I was being false which I am not. So should Ijust leave it alone? I cannot afford an attorney. I am living with a family since we left him and I've been in a car some nights and a shelter. I just want to make sure he goes to court forall this stuff.

I got out immediately. He is reported to police and is out on bond. He has several charges. I hav been to my shelter and in therapy. i am so tired. Hekept me isolated so it was even more hard and we were togthr for a while but only got married this spring

I pointed out a couple of things that would not necessarily be a crime - being a habitual drunk or making a living primarily from gambling - but they would disqualify you as a person of good moral character.

I suggest you get in contact with a good charitable organization that specializes in helping battered wives and immigrants. Catholic Charities is one such organization. They could usually provide you with legal assistance at no cost.

If your husband threatened to contact USCIS with derogatory information about you then he may have done that. It's possible that's what caused this.

Thank you. I will google some charities immediately. There is one I tried to contact in my state but unfortunately it's 8 hours away and I can't leave a message so I've been calling over and over and over.

Read my post more carefully. "Good moral character" does not have the same definition as "clean criminal record". I gave two examples which are specifically cited in the law - being a habitual drunk or making a living primarily from gambling. Neither of these are crimes. Neither would result in a person having a criminal record. Both of these would qualify someone as a person who is not of good moral character.

Another example which is specifically cited in the law is giving false testimony. It's possible she made a statement to the police or to the judge, her husband countered with evidence to the contrary, and the judge bought it. USCIS would be free to conclude that her original testimony was false. I suspect the denial letter probably describes the reason they concluded she was not a person of good moral character.

One of the requirements of vawa is that you have to prove you are a person of good moral character, for that you have to send a police clearance of the states that you were residing for the past 3 years. You should send the police clearance asap. Did you write your statement? you must be missing something else... What other evidence did they asked for? You should move to the vawa forum...
