Hey Guys,

I my evidence has been received by USCIS a week ago. My 5 months are up this Monday. Is it advisable to involve senator? THE RFE was regarding a signature mistake. Not sure what to do.

Remember that five months is a goal, not an absolute. If there was an RFE, then you need to add some time for them to get that and process it.

Be patient. This takes some time.

You can certainly contact your representative or senator, but at this point their staffer will probably say "wait a few weeks".

Senator/congressmen do not help... First-hand experience. You can try though.

They did. I would say a little bit of both. The staff did follow-up but not actively, meaning that they just don't care. In addition, USCIS will not answer the senator anything different from what they tell you.. Same thing, just extra useless movements...

Did you call USCIS and ask them for a service request? If you haven't...call and ask for one. I usually get pretty quick answers after I have put in service request.

I called USCIS, but they asked me to wait for 7 more weeks before they can put a service request for my case. Thats why I thought to contact senator instead.

I say wait until it's 6 months + 3 weeks. Then, if you not have approval by then, get busy. Just my opinion.

You mean wait for 7 more weeks?

What if I get another RFE, after 7 weeks. The process has already taken 5 months and then additional 4 months. I think that is a bit too much. So much for completing a case in 5 months.

Senator will not help even if he/she could. This is normal and within normal wait time. The fact that you got RFE is your fault, not USCIS. Normal wait time 5 months. plus 7 weeks RFE (likely less). Thus no one will do anything until 5 months PLUS 7 weeks for each RFE.

hey there...

if u have sent in ur RFE a while ago, i would give it about 20 business days... they process RFE's quickley...

and if u want to take senators help go ahead... thats what i did and my case was handled quickly after 5 month mark...

it can never hurt ur chances... if it wont help it wont hurt either...

Hey Guys,

Respond to the RFE accordingly, then wait the additional time for re-adjudication.

August 23, 2010 - I-129 F package sent via USPS priority mail with delivery confirmation.

August 30, 2010 - Per Department of Homeland Security (DHS) e-mail, petition received and routed to California Service Center for processing. Check cashed. I-797C Notice of Action by mail (NOA 1) - Received date 08/25/2010. Notice date 08/27/2010.

After 150 days of imposed anxious patience...

January 24, 2011 - Per USCIS website, petition approved and notice mailed.

January 31, 2011 - Approval receipt notice (NOA 2) received by mail. Called NVC, given Santo Domingo case number, and informed that petition was sent same day to consulate.

Called Visa Specialist at the Department of State every day for a case update. Informed of interview date on February, 16 2011. Informed that packet was mailed to fiance on February, 15 2011.

February 21, 2011 - Fiance has not yet received packet. Called 1-877-804-5402 (Visa Information Center of the United States Embassy) to request a duplicate packet in person pick-up at the US consulate in Santo Domingo. Packet can be picked-up by fiance on 02/28.

March 1, 2011 - Medical exam completed at Consultorios de Visa in Santo Domingo.

March 9, 2011 at 6 AM - Interview, approved!

March 18, 2011 - POE together. JFK and O'Hare airports. Legal wedding: May 16, 2011.

I engaged my senators office also. The USCIS doesn't really care if a senatorial aide makes inquiries. Only if you can actually get the senator involved which is a long shot will it make a difference. Still doesn't hurt and it gives you a piece of bona fide evidence for the consulate

I have an approved i130 petition, I contacted my senator at 4.5 months, They made a call and the case was complete the following week. The senators office told me they would continue to contact for me and the case was resolved quickly... It depends which person you get i guess though... But mine was assigned to a case manager the same day the senators office called.
