B1/2 VISA, MARRIAGE, AND AOS

Timeline

I came to the United States when I was 7 years old with my parents on a B1/2 visa, and what a journey that has been. I have since overstayed, grew up here, and I didn't begin to understand the depth of my situation until I was 18. I am almost 23 now, married to my high school sweetheart, and we're beginning my AOS process in a few days.

If anyone has been through a similar process or has any helpful input, please share your experience/opinions on what you're process was like and any bumps we might hit?

PROLOGUE

02/03/1997 - Arrived in the U.S.

10/??/2006 - Met in High School

08/05/2010 - We Got Married!

AOS

11/18/2011 - Medical Exam I-693 ($140)

12/05/2011 - Day 0 - Sent our package

12/07/2011 - Day 2 - Package delivered (USPS Confirmation)

12/09/2011 - Day 4 - Received text & email confirmation

12/12/2011 - Day 7 - Received NOA for (I-130, I-485, I-765)

12/17/2011 - Day 12 - Received NOA for biometics

12/21/2011 - Day 16 - Online Update: USCIS mailed RFE for I-485

12/27/2011 - Day 22 - Received RFE for blank/missing page 5 of I-864/Mailed back RFE response

01/05/2012 - Day 31 - Successful biometrics

01/19/2012 - Day 45 - Online Update: USCIS mailed notice for interview!

01/21/2012 - Day 47 - Received NOA for interview (Feb 27)

02/13/2012 - Day 70 - Online Update: EAD Card Production

02/16/2012 - Day 73 - Online Update: EAD Card Production #2

02/17/2012 - Day 74 - Online Update: EAD Card mailed

02/21/2012 - Day 78 - EAD in Hands! (Applied for SSN)

02/27/2012 - Day 84 - Interview at USCIS Detroit (No decision on the spot!)

02/27/2012 - Day 84 - Online Update: USCIS mailed notice of new permanent resident status!

03/01/2012 - Day 87 - Online Update: GC/I-551C Card Production

03/02/2012 - Day 88 - Online Update: GC Mailed

03/05/2012 - Day 91 - Green Card in Hand!!

As you can see, we have a whole forum devoted to people who are adjusting their status from either a tourist, student or work visa and who hope to become Permanent Residents through their marriage to a US citizen. Your case is actually fairly straight forward. Overstay is irrelevant/forgiven for immediate relatives of US Citizens, which includes a spouse.

Possible "bumps," as you say, might include the following: You will have to prove you entered legally and get your 15-year old visa and I-94 document. You will have to be honest about any illegal work you did, and it's recommended to file taxes for every year you worked, if you haven't already. You will not be able to use the Advance Parole travel permission, and will have to wait until you get your GC to travel. Good luck!
