How many I-864 and I-864A should I send to NVC?

The sponsors will be myself and my mother. (I am the petitioner). So far, I have only filled up one (1) I-864 and one (1) I-864A which has my mother's information. Me as the sponsor and my mother as the household member.

I need help on this AOS part. Any advice would be greatly appreciated!

Look at the US poverty guidelines first. You said mom lives with you, so this will make a family of household size of 3 (you, mother and new wife). Look at the poverty line for 2011 for a family of 3 and multiply by 125%. Which will be the total income you need to be able to support you new wife. Can you, by yourself meet this income test. If not you can have your mother be a cosponsor and then you would need her to fill out form I864A for you.

PS I believe the US poverty line for 2011 for a family of 3 is 18,530x125%=23162.5 (please someone correct me if i am wrong, I did not have to worry about that part of my app). Of course on form I864 you can choose to include your mom or not (in 21g). If your mom is not your dependent (you are not providing most of her support and you don't need her income to reach the poverty guideline you don't have to include her).

Thank you for the response. My yearly income did not meet the US Povert guideline that is why I have to include my mother as co sponsor (is it also correct to refer my mother as the joint sponsor?).

Do I also fill up an I-864 for my mother? Also should my wife (beneficiary) be included as a household member? I'm a little confused with that.

My mother also filed a joint tax return with my father so I'm assuming I might fill up another I-863. What should I do?

PS Quick question, if my mother lives with me in the household but they are not my dependent, am I allowed to just be the sponsor and not included my mother just like you mentioned

Yes. My 2 brother also lives there. I have enough income if I look at the poverty guide for the household size of 2. What should I indicate?

If your income is sufficient then no joint sponsor is needed. Do you claim anyone else as dependents on your tax return? Any minor children? If no and no, then your household is two.

That's good news then. So just to be clear, I live with my parents and brothers and I am not a dependent of of any of them, vice versa.

I'm going to revise my I-864 and indicate that I will be the only sponsor and the household is 2. Is this okay?

Yes, that's OK and preferred. If you qualify as the joint sponsor based on your own income, the fact that you live in your mother's house is of no concern. Just complete the I-864 or I-864EZ as applicable, as if you currently live alone and have no dependents.

Facts are cheap...knowing how to use them is precious...

If you need a joint sponsor, you use the I-864 and another I-864 for your mother, provided her income is sufficient for her own family size plus your spouse. It's dicey trying to use an I-864a from somebody who is the head of a household. Only do that if you need to combine income.
