Hi everyone,

I am a US Citizen (born and raised in LA) / my husband is from Germany with a L1-B Visa (valid till 2014) - still German citizen of course

short story (the last 2 years): we met on a plane, fell in love, got married in the US - he gave up his life and settled with me in the US. He works on a L1-B Visa which he got from his employer. With this Visa he is stuck to his employer, so we want to get his Greencard asap. so he can apply for another (closer) job in the US.

Status as of today: we filed the I-130 form and got the approval (I-797, Notice of Action), NVC contacted us with NVC Case number and requests to pay the AOS fee for further processing - but how?

NOW! All topics here mention filing requests for relatives living overseas but what to do if he already lives and works here with me?

I am really stuck at this process as there are too many forms and regulations...can someone help me with a procedure to make this work?

We don't want to fly out to a German embassy again for a stupid interview (he did this for the L1-B VISA already and the interview was ridiculous) there must be a way to file if from here in the States...is there? And if how to proceed from now?

You would not be pursuing a spouse visa as he is already here lawfully. I suggest that you read this Adjust Status guide to learn the steps to be taken. There will be an interview (stupid or not) here in the US that both of you will attend.

Follow the guide linked above, and send in a copy of your I-130 approval with your I-485. The guide is for concurrent I-130/I-485, so make the necessary adjustments. You don't need to pay anything at NVC -when you send in the I-485 and related forms they will get your I-130 back to USCIS and follow a different process. Good luck.
