Hi everyone,

I've seen so many VISA refusals lately that I'm getting nervous.

Going over our case, it came to my mind that since I'm 1 year and 5 months older than my husband this could be a red flag.

We are applying for a IR1 visa, we've been together for almost 5 years in July. Have 2 kids, both of them American Citizens with passports. Legally married for 3 and our religious ceremony happened almos 4 years ago in September.

I've never been an ilegal in the States, never been denied a VISA or at POE.

Please give me your advice I highly needed it!

i don't see why that amount of time would be a red flag. there are many other couples that the woman is much older like 10, 15 years. i wouldn't worry about it too much. perhaps go a little more indepth and ask others who have gone through your embassy about that. i'm sure some embassys are more picky than others. where are you in your visa process?

12-14-2010 - Check for I-130 Package Cleared.

12-17-2010 - NOA1 (Hard Copy) Received.

02-28-2011 - Touch (For Entering Case Number into System)

03-18-2011 - Visited Hubby in Nicaragua for 9 Days

04-12-2011 - NOA2 ~ 132 DAYS!!!

04-13-2011 - NOA2 Notification Email

04-16-2011 - NOA2 Hard Copy Arrives

IMO, this gap is not a red flag. If the age difference had been 10+ years, then I would have different opinion.

January 28, 2014: Production of new Green Card ordered

February 3, 2014: New Green Card received; done with USCIS until fall of 2023*

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

I forgot none of my close family members have been ilegally in the States.

We have a cosponsor since my husband's last year income was not enough, but this year he's got a better job and makes enough, anyways we had a cosponsor just in case he was not approved.. and the cosponsor makes way beyond the poverty level.

We are having our interview next month and God I'm stressing out already...

Right now I'm collecting as much evidence of a bonafide marriage as I can...

We have a lot of pictures

We have notarized affidavits from my parents and my husband's parents about our bonafide marriage

money receipts from the time we've been apart (he's in the States I'm in Mexico)

phone logs (this is our primary way of communication)

e-mails

chat logs

cards from him and his parents and the ones addressed to the kids

and as we met as volunteers I have newsletters and ID's from the time we were doing missionary work

Is there anything else we could get to make our case stronger?

Please I need your input :)

I'm kind of freaking out!

CDJ is one of the most efficent and easiest consulates in the world when it comes to immigrant visas where there have been NO immigration violations--you'll do great--just follow their procedures to a tee--they are very fussy when it comes to procedures.

When we filed our case at NVC we sent only 2010 tax returns and last paycheck from my husband and our sponsor.

I called and they said to bring an employment letters for both of them, to which my husband is working on getting them.

they didn't answer my question whether or not to bring 2008 and 2009 tax returns or last 6 month paychecks though they just say to bring what I consider necessary,

to what I say what in the world?

My husband and cosponsor work together and get weekly paychecks now getting the last six months would be a huge thing and our co sponsor's tax returns from 2008 and 2009 are huge since he was self employed...

If I were to bring that much evidence that would be a huge file.

My husband says to bring only 2010 tax returns, employment letter and las month paychecks

I wonder if this would be enough?

You want somehting that shows year to date income--if that is on the most recent pay stub, then just using it is OK, but if not, then you need several months of proof--they want to make sure that a single pay stub doesn't misrepresent his actual earnings.

Absolutely bring the 2008/2009 tax returns--that is no big deal--just stick them in a folder, and while they are unlikely to ask for them if current income is strong, there is no downside and only upside to have them. Let hubby gloat when you have them and they aren't required ratehr than you being disappointed when they ask for them and you don't have them.

This is not the time to cut corners--you are almost over the finish line.

you said you have children together, bring their birth certificates, this is good evidence for bonafide marriage
