Everywhere I've read that the K-3 is dead because it is processing at the same time as the CR-1. Anyone have any luck with the K-3? Would love to know how long it took and what country your spouse was from.

Thanks!

Luck has nothing to do with it. USCIS closed the K 3 option. All you need to do is file for a C R 1 which is better & took the same amount of time. In the end its better & cheaper.

USCIS closed the K 3 option.

That's not correct. USCIS typically approves both the I-130 and an I-129F filed in conjunction with it at the same time because they would have been tied together. USCIS then sends both petitions to the NVC. When the NVC receives the two approved petitions, it administratively closes the I-129F leaving only the I-130 active.

NVC is part of the State Department, USCIS is part of the Department of Homeland Security.

Administratively closing an I-129F filed in conjunction with an I-130 when said I-130 has already been approved is State Department policy. USCIS or DHS has nothing to do with it.

The K3 is still officially on the books (the LIFE Act in 2000 created it), in current practice, it's nonexistent.

Ok then you suggest he files both petitions? Even though in current practice its nonexistent?

No, I was not suggesting that at all. I have posted many times (and doing so again) that filing a I-129F in conjunction with an I-130 is a waste of time.

The purpose of my post was to explain what NVC policy is and that USCIS plays no part in it.

Ning - if you look at the posts in the K-3 forum - for the last 6 months -

the majority of them have been moved out, as they really weren't K-3 visa topics

but -- dig around, you'll find some heated discussion on what's what, and why it's really silly these days to chase after a K-3 visa.

Good Luck !

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !
Ya know, you can find the answer to your question with the advanced search tool, when using a PC? Ditch the handphone, come back later on a PC, and try again.

It isnt me that needs the info on K 3s. The mistake I made was in thinking it was USCIS that closed them. Ryan says its NVC & I am sure he is right.

In any case the K 3 isnt worth consideration. I thought the OP wanted to know the time difference in K 3 or C R 1. The OP wants to weigh his situation against others which we know is a waste of time but we are here to help. Hopefully the OP gained some knowledge.
