My wife's son (12 years old) is living & studying in Philippines & I want to petition him so the 3 of us will live here in Chicago together.

Currently, I'm the only 1 here in Chicago, my petition for my wife just got approved last April 2011 & we're on the Final Stages of the NVC & hopefully she'll be here around mid-September. smile.gif

1st Question:

Assuming the petition has already been approved for my step-son. When he gets here in US, what can I do so he can have me as his Father registered on his Birth Certificate & have him use my last name? (currently he has no FATHER registered on his Birth Certificate - it states UNKNOWN)

Pls advice of the papers/forms I need to file if there are any.

2nd Question:

When my step-son gets here, what would be his status? USC or Permanent Resident?

** 3rd Question if necessary:

Assuming the answer on the 2nd question above will be USC. Will my wife be automatically be a USC too? since its her true son? or she has to wait 3 years for Naturalization process?

1) I'm not really sure about this but to have your last name you would have to adopt him and file as parent instead of filing as stepparent.

2)You could have filed for them at the same time, one i130 for your wife and one i130 for your stepson.

Both your wife and stepson will be LPR, she can file for USC having been a LPR for 3 years and married 3 years.

once she is a USC, she can derive her citizenship since the child will be under 18.

ADOPTION, refer to your state laws for the process and procedure. This has nothing to do with immigration.2nd Question:

He will be a Permanent Resident.

They both will have to wait 3 years, only if you adopt the son would he have a faster route to US citizenship. Adoption of the son does not give the mother a faster route to citizenship.
