Hi there:

I am new in this forum, I hope somebody can help me to file the correct affidavit of support.

I file I 130 to bring my mother from Peru, the I 130 was approved. All the documents are in NVC , I have already paid $88 and $404, now NVC requires me to file the affidavit of support, which form should I file I 864, I 864 A or I 864 EZ, I am reading all the guides and instructions but I am getting confuse about the correct form. First, I am a housewife with two small children, my husband makes all the income, He is under W-2, we both file income tax return together as a couple. My question is since I do not work, should I file affidavit I 864 for my mother and my husband will be a joint sponsor signing the form I 864 A? or Should I file another form?. Please somebody can help to clarify my ideas.

as the petitioner you have to file an affidavit of support.

you will file the i864 and your husband will file the i864A as household member.

Thanks for answer my question. This forum is very helpful. Also, do anybody know if I have to file adjustment of status too ( I -485 ). My mother is in Peru no in USA, she is going to wait in Peru to get the Visa to come to USA. Is necessary to file the form I - 485 or this form does not apply to my case?

No need for Adjustment of Status, she will get a greencard when she enters the USA.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
