We are a K-1 expecting to adjust status after we get married.

1) I'm confused, do I have to or not have to file I-130? I don't see it in the guides, but I saw it on the USCIS site.

2) You're supposed to file AOS before I-94 runs out? Seriously? What if we plan on getting married on the 88th day? Should he wait to enter the U.S. so we have enough time for marriage plus AOS filage?

3) If answer to number 1 is Yes, do we file the I-130 and I-485 together? Or do we have to wait to file the I-485 until I-130 goes through?

4) I'm guessing soon as honey lands he can file for SS#? I thought I read that somewhere even though that sounds crazy to me.

I think that's it.

1. No - you apply for AOS based on your approved I-129F and your marriage certificate.

2. Best to apply ASAP, but no penalty if you file after your 90th day - just be married before the 90th day.

4. People suggest to wait 2 weeks to apply for SSN, just to give time for his name and arrival to make it through the various agencies. If you wait until too close to when the I-94 expires though, then he will have to wait for EAD or GC to get a SSN.

Please read the AOS guide for K-1 holders. All steps you need to follow are there.

1) You only file I-485 (and EAD And AP if you want to). No I-130.

2) The requirement is to get married within 90 after you enter USA. If you want to do it on the 88th day, it is your choice!

3)See #1.

4) No as soon as, but the beneficiary can apply for a SS#. Just wait at least 10 tens after POE so the file is in the system.

Read the guide and there will no problem! :)

No, Read the Guides for AOS

2) You're supposed to file AOS before I-94 runs out? Seriously? What if we plan on getting married on the 88th day? Should he wait to enter the U.S. so we have enough time for marriage plus AOS filage?

No, you should file it before he dies.....literally, there is no time limit. Best sooner than later but no time requirement.

3) If answer to number 1 is Yes, do we file the I-130 and I-485 together? Or do we have to wait to file the I-485 until I-130 goes through?

Best is to wait two to three weeks before applying for the SSN to allow his arrival to filter through the government computers; if you try too soon, it can actually slow things down.

You have already petitioned him (I-129F) so no I-130 is required.

I-130 is necessary though, when people apply to adjust from tourist and other visas.

My Immigration Journey:

K1: June 2010 - December 2010

AOS: April 2011 - June 2011

ROC: April 2013 - August 2013

Naturalization: March 2014 - August 2014
