Received a NOA for more info (biometrics done already)

Background: I'm the US citizen and wife is applying to have condition removed. she's already done biometrics but then we get notification that we need to provide more evidence (of joint residency).

btw, we've already sent in 3 years of joint federal taxes, car loan, wedding pictures!! (like with 200 guest!!), joint bank statements, credit card, health insurance in the initial application.

what concerns me is that we don't own or rent so I'm not sure how to prove we live together. We've been living with my parents for the past few years now. (tons of student debt on my part - was close to 100k, and we're trying to save up that 20% for a house + bad economy...it just made sense for us). Obviously, we don't have any utility bills. I mean, we'll help the parents pay stuff like cable/phone bills in lieu of no rent but then again, it's not in both our names.

I was hoping I could have my parents write an affidavit of some sort to say what we're doing. Any ideas?

worst case, what happens if we're rejected this 2nd time around?? I'm just a little bit stressed.

hi there! i was in the same boat (kind of) when i first put in the papers for AOS. Me and my husband lived in our friends one bedroom apartment above her garage and was just a verbal agreement when we started. Once i found out we needed some evidence of living together, i had her type up a "rental agreement", and basically put our verbal agreement on paper, and we all signed it. And we submitted that. I think in this case you can do the same thing here. You could do this or go down the road of getting your parents to write an affidavit to go along with the rental agreement.

i would also send in some letters and other mail you may have received to show the address. even if both your names are not on it, at least they can see the co-living.

hope this helps!! good luck!

Better than an affidavit...make a rental agreement and everyone sign it. They do not check to see if you actually pay your rent. Nor do they pass judgement on the amount you pay.

I think a notarized affidavit from your parents should be adequate. Just make sure you include the required info for any affidavit and have them state that you are living with them to save money and that you help out with bills. Why make up a fake 'rental' agreement last minute? The truth is the truth, go with that.

I never suggested anything fake. I suggested a REAL rental agreement.
