Since the petition got approved before the withdrawal letter caught up with it, I doubt you have any problem. You can certainly call USCIS but I think that's what they'll tell you. Expect things to simply go forward as if you never sent the withdrawal letter.

Call USCIS and ask for tier 2 person, they are very helfful. I needed some help few years ago with my citizenship certificate, i called and requested that they referred me to a tier 2 person, the next day my citizen naturalization certificate mailed express. They have all the current information with them and can request and make any possible request that you might need.. Have faith,and please please do not lose hope. Long distance is not easy,but with faith and dedication things will definately workout..Call them and ask for tier 2 or stop by immigration office and ask to speak with a manager or supervisor. Most offices require an appointment tho.

NOA2 August 12th

Guess my fiancee and I are blessed in that are because in 2 and a half years of our relationship we have not even had so much as a strong dissagreement. That's mostly because of her - the way she is, and somewhat because I was married to a Filipina before for 13 years and learned some things from that. Anyway I'm glad you two worked your problem out and I hope its smooth sailling for you both from here out.

Hi Everyone,

Well, I received my NOA2 today via email. That's the sweet. The bitter is: on the week of April 4th I sent a letter asking that my petition be withdrawn. My fiancee and I had a big fight and in a moment of stupidity I sent that letter. The following Monday,the 11th, I sent a letter to VSC via fedex overnight asking that my previous letter be canceled and explained why. My fiancee and I have resolved our misunderstanding. So at this point I have no idea if I will be receiving a letter in the near future saying my petition was withdrawn. I guess I'm writing this post to anyone who is having problems with their loved one who is far away and is thinking of sending that withdrawal letter. Take some time to think about it and really make sure you want to send that letter. I'm going to call USCIS tomorrow and ask if my withdrawal letter had been canceled but I really don't think they will be of much help. I guess I'm in limbo now...

I think the stress of this process makes many wonder about "throwing in the towel" before NOA2 arrives. I remember feeling specially desparate and frustrated just before our petition was approved. Once the petition is approved, things move fairly fast! I do not know whether they will honor your "withdrawal cancellation request," but thank you for sharing your story as a warning to those who might be thiking about giving in.

August 23, 2010 - I-129 F package sent via USPS priority mail with delivery confirmation.

August 30, 2010 - Per Department of Homeland Security (DHS) e-mail, petition received and routed to California Service Center for processing. Check cashed. I-797C Notice of Action by mail (NOA 1) - Received date 08/25/2010. Notice date 08/27/2010.

After 150 days of imposed anxious patience...

January 24, 2011 - Per USCIS website, petition approved and notice mailed.

January 31, 2011 - Approval receipt notice (NOA 2) received by mail. Called NVC, given Santo Domingo case number, and informed that petition was sent same day to consulate.

Called Visa Specialist at the Department of State every day for a case update. Informed of interview date on February, 16 2011. Informed that packet was mailed to fiance on February, 15 2011.

February 21, 2011 - Fiance has not yet received packet. Called 1-877-804-5402 (Visa Information Center of the United States Embassy) to request a duplicate packet in person pick-up at the US consulate in Santo Domingo. Packet can be picked-up by fiance on 02/28.

March 1, 2011 - Medical exam completed at Consultorios de Visa in Santo Domingo.

March 9, 2011 at 6 AM - Interview, approved!

March 18, 2011 - POE together. JFK and O'Hare airports. Legal wedding: May 16, 2011.

Depends on how you filled out the letter. Did you include both of your names and dates of birth. NOA 1 date and case number? How exactly did you word it. I sent a withdrawal letter and they sent it back and I really did want it withdrawn. If you made any errors at all it will not be accepted. It almost takes an act of congress to get it withdrawn.

So like pushbrk said they may not even do anything with it.

I remember the Original Post to withdraw. I never commented but understood there is a stress factor and doubts of decisions. It is quite common to argue and have doubts through the process. I agree with Pushbrk that it will not stop the process but, I'm Courious, did you have the withdrawel Letter Notorized. Follow-up on Calls to be sure you cancelled. If unsure. Make a Info-Pass Appointment. (talk to a human being) . Good luck !

Stephen!!! I just want to say I wish you both the best!! There were times I felt like throwing in the towel, but we perservered and our life is GREAT! We had a baby girl last Oct. that has brought so much Joy to our family. Consider this a small bump in the road. Life will be back on track for you two very soon.... Let us know what you find out. Just like Pushbrk said, I don't think you have anything to worry about....... :thumbs:

Hi Everyone,

Thanks so much for your posts. I called USCIS today and I was told that at this point I need to contact the US embassy in Manila and let them know I don't want to withdraw the petition if they receive the letter I sent to the VSC. I'm not really sure what to do at this point. Perhaps I should just do nothing at this point and just hope for the best. In my withdrawal letter I did include my name, her name and my receipt number. And the reason I wanted to withdraw my petition. I'm realizing that the burocracy (sp?) may be in my favor because of the fact that I did receive an approval even though I sent the withdrawal letter. I know I'm not out of the woods yet because that letter may yet bite me in the #### at a later date. I hope pushbrk is right and that the letter I sent will just never go anywhere. I hope I will have good news to report in the future. I feel blessed to have all of you rooting for me..Thank You...

i say definitely contact NVC and make sure it gets sent to Manila and then contact Manila

the bureaucracy may totally be in your favor ( i sent a request to VSC, the put it on a desk and approved me without noticing it, i had to re-request it at NVC)

It's definitely understandable how this process takes its toll on relationships. I hope it works out for you.

I'm thinking of withdrawing mine for a different reason- due to a bunch of circumstances, we're considering living abroad instead of here in the U.S. Most of us here on VJ are prob just ready for some stability with our significant others, one way or the other.

May 2008- L is pushed into jagged rocks by a 12 ft wave while surfing in Chile. K saves her from certain watery death. Performs CPR and secretly enjoys it.

Sept 2008- L returns to the U.S. to finish school.

Dec 2008- K wins a surfing competition, uses prize money to buy L ticket to Chile.

Jan 2009- L visits K in Chile, 5 months pregnant!

April 2009- future world champion of surfing is born

Nov 2010- engaged!

Nov 28, 2010- petition sent

Dec 3, 2010- NOA 1

Dec 10, 2010- touched

May 6, 2011- NOA 2

May 17, 2011- sent to Embassy from NVC

In your situation, there's really no compelling reason to withdraw the petition.. If needed, you can withdraw it when and if you file a spouse petition.

Facts are cheap...knowing how to use them is precious...

sometimes it is hard. Long distance never makes a relationship easy when you found someone to be with. sometiems just understanding how messed up some processes are, is not easy to understand. My biggest thing I have found is there is family and friends involved in my fiance and my relationship. When something happens, we go to each toher's friends and family for help. Talk things out, and allow for a period to understand each other. if it wasn't for knowing the culture and having friends and family from her village here in my town to help, things would be really really tough. For those of you without friends and family to help your relationship, I really feel for you. It will take ten times more work to get through issues. best of luck, and even if you lose the NOA2, hopefully you can get it re-instated again quickly. Just fill out a waiver and explain why.
