More Evidence Request....

Hey Everyone

Everyone on here has helped me out so much over the past couple of years, so i am calling on you all again to help me solve one last thing.

My marriage sadly ended in divorce after about 20months of being married. I filed for removal and the response was that they needed more evidence of 'Significant financial responsibility' for the term of the marriage.

My wife already had a house, and to add my name to the mortgage would have meant a new policy in a bad housing economy. So we never changed the names, and we never thought to add my name to utility bills, we just paid them. We had joint medical and car insurance, joint phone contracts, joint car loan, files our tav returns together to show all this, and they still want more? So i managed to get copies of our joint bank account statements to send in, will this be enough on top of what i sent before? My wife kind of purposely destroyed a lot of the documents i would have needed to prove us both paying the bills.

I didn't get married so i could add my name to financial ties just to prove that i married the the right reasons. I don't get why the immigration service see commitment and a healthy marriage in a financial way - its very annoying! If thats how they view it, anybody could come into the US and just get joint financial responsibilities, and viola! you're in! It sucks!

If anyone can help me out with anything else i could send in, or if anyone else has been in a similar situation?

Thanks to all in advance!!!

Did you file as divorced or with your wife?

It could be that they lost your financial documentation. You may want to send copies of what you sent the first time along with joint bank account statements. Did you have joint credit cards?

Well if it's a fraud marriage most people are not willing to comingle their finances. That is why USCIS asks for proof that you are living as a real couple.

Hey there,

I'm not really in the same situation as you, but I can tell you that i'm feeling the same way. Most everything in my name because well my husband didn't have credit so it was easier/cheaper that way. I did send them proof of joint bank account, proof of joint car insurance, 2008 taxes, probably 20 other documents that show the same address like cards we received together pay stubs etc, sent a letter from my credit card saying he's an authorized user. Sent just a letter from another credit card that had both our names on it. Plus two letters from family/friends saying we live together have a happy, healthy marriage etc. Apparently all that wasn't good enough because they want proof of where he lives, his birth certificate (which I know we've already sent twice before, I can't believe they wouldn't keep files on people) and proof of joint finances. So i'm going to send everything I sent the first time again, get anyone who has ever seen us together that I can think of to write a letter for me, if I can get like 20 letters from people attesting to the fact that we're legit and that isn't good enough then I guess we'll just move to England, it's so frustrating because I know if it were the other way around and I wanted to move to England we could have my visa in 30 days and be done with it, we've been together nearly 9 years, I hate that stupid pieces of paper are supposed to show we married for the right reasons.

You could always invite them over for tea! hahah I assume they would interview you if they didnt find the evidence as sufficient and I am sure after nine years of marriage they couldn't stump you in an interview!

Well if after 9years and all the documents you sent they are still giving you trouble, then i don't have much hope :(

I sent in 7 affidavits of support, including one from my ex-wife!

They didn't list any extra documents, apart from the ones for financial responsibility.

Crazy thing is, i got a fiance visa first and had to prove it was legit 3yrs ago. So weird!

haha! We've been married 3 years, but together nearly 9 years. I'm almost certain there is nothing they could stump me on. I think I can get a lot of people to write letters in the next couple weeks, people from work, family at Easter. They want the stuff back by 5/26 so I have a little time at least.

They don't seem to be questioning our joint address, as they have lots of things with our joint address on it. But will see what i have.

The divorce happened as my ex-wife had some issues that she had to go for therapy for. Became Bi-Polar and split personality disorder. She was medicated and it was how she changed as a person that over time saw us break apart. What sucks, is that it was all down to things her father did to her as a chile, abandoning her and things, and it was me who wanted to help her sort them out. She is fine now, a different person, but fine. But at the cost of our marriage.

I have put my evidence this time in month order. With that months bank statements, emails and pictures etc. I dont have anymore documents to send really. She destroyed all of them, kind of knowing i would need them!

Byg4857,

You are mostly welcome to join the 751-waiver thread for people who filed the 751 with a waiver such a divorce, death..etc.

Yes, I did send some more evidences but it was tough. A lot of utility companies dont keep records for more than 16 months and since I moved out, I didnt have access to our old bills in the house. I never updated the beneficiary on my life insurance so I was able to get that without any problem.

And yes, unfortunately, I do have an interview next week.

Good luck! Hope they see sense!

Yes, I am glad I got the interview to explain the circumstances instead of plainly denying me but I said unfortunately due to seeing people with less evidence than mine get approved without an interview.

You can get transcripts from the IRS, showing you filed jointly. They are free, and only take about 2 weeks to get in the mail. Or you could have them faxed to you (if you have a fax number).
