Interesting Interview Experience

Hello All,

Earlier my wife and I went in for our initial interview, and in all we would say it was a good interview. However a greencard was not approved or denied, let me explain:

The officer was very nice, and swore us in.

Went through our application and noticed, a section of medical was missing (my doc simply forgot to include it), he said this was a problem and said it may be sent or brought in within 30days.

He then asked myself (the beneficiary) a number of questions verifiying the info on the i130 and i485; such as address, dob, criminal record and etc.

Afterwards, he asked us for evidence of our relationship. We showed him old pictures of ourselves (back from 2005) which he was def. impressed by, bank statements, and rental contracts. He took brief notes and wrote it on our i130 app and i4855.

He did not ask my wife, the sponsor any questions. and gave us back the documents.

He said once they receive the missing doc. we will receive a response within 3 weeks.

He took my i94 and gave me back my EAD.

Does anybody have a clue what I should expect? A rejection letter? A green card?

I like to believe he could tell our relationship was very much legitimate. We are both the same age, same race (i know it shouldnt matter, but you know), my wife is pregant ( we had pics of sono), and niether of us had prior marriages.

Yes, I went directly to the doctor. Received the document, and sent it instantly. It should arrive today or tomorrow.

I am actually adjusting from a visa waiver overstay. He did not mention/ ask any questions about it.

Then everything should be a ok. Visa Waiver Overstays are a non issue now , They just want to make sure your marriage is true. You can take a breath :)

This is generally true, they just published this in a Q&A with AILA this week:

All field offices have been instructed to adjudicate I-485 applications filed by individuals who last entered the U.S. under the Visa Waiver Program (VWP) and overstayed on their merits UNLESS the potential beneficiary is the subject of an INA section 217 removal order. Additionally, field offices have been instructed to hold in abeyance all VWP adjustment applications for potential beneficiaries who have

7

been ordered removed under INA section 217. We are drafting final guidance including an AFM update on this topic we expect to issue soon.

****The only snag that was not mentioned here is an NTA.. assuming there is none it should be ok. If there is one looks like they will hold in abeyance for now.

Thanks all.

Its pretty ironic, because I really liked the doc from the i-693 he did back in oct. so I made him my GP, and even recommended him to fam & friends. But either way, I think it was a genuine mistake. Hopefully I'll receive something in the mail. *fingers crossed*

Actually no it's true.

The OP isn't in removal proceedings so the abeyance part does not apply. Thanks anyway.

Thats everybody,

it looks as though my application was approved. On 4/20, the USCIS website says my card was ordered for production, and yesterday I received my welcome letter.

In all the last 5 and a half months have not been as terrible as I imagined.

Thanks all. Just waiting for the actual card now
