INterview w/ Expired Passport?

HI all...wondering if anyone can offer their 2 cents.

I was not allowed to renew my passport at the NY Embasssy and was told that i needed to return to home country to get it done. My Lawyer told me that I should have a valid passport when i have my interview.

What happens if i show up to the interview with an expired passport?

7/28/11 Interview approved. Dude stamped my applications on file.

8/03/11 online update CARD PRODUCTION (2nd Time)

8/04/11 online update. APPROVAL LETTER MAILED.

8/05/11 Received Approval Letter in the mail.

8/06/11 Received GC!!!!!!!!!!!!!!!!!!!!!!!

I see nothing saying you can't go to an interview with an expired passport. (or even the biometrics).

How much time did you have on your passport when you first entered the US? (when did you enter?)

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

I came here 20 years ago. Overstayed with my parents.

I see nothing saying you can't go to an interview with an expired passport. (or even the biometrics).

The expired passport is not a problem, but since your passport is so old, you will need a current form of valid ID.

You could also check how your home country processes passports for citizens who are in a foreign country. If the embassy can't do it, you may be able to do it by mail.

4/2/2012 Green Card In Hand!

Unbelievable that my journey took this long but Im thankful

Next Stop Premed...Yup!

9/22/2014 APPROVED without interview.

Home country is Malaysia. PPl can renew their pasport abroad if they have an IC card(ID CARD). BUt i left at such a young age that I dont possess one and never been back.

The expired passport is not a problem, but since your passport is so old, you will need a current form of valid ID.

DL will work. You probably wouldn't get an EAD unless you submit a copy of the DL or other ID with your forms.

If I dont get denied after interviewing, dont they stamp the passport?

They usually only put the I-551 stamp in your passport if you need to travel before the GC arrives. I'm not sure there's any reason they would stamp an expired passport since you can't use it to travel anyway.

You won't have a problem since you have a DL. My husband's passport was long expired. We did still take it though because it has the I-94 and visa in it. Our IO took his expired I-94 out. So you should probably take that. Also, it's not common practice to stamp the passports at the interview even with immediate approval...and especially since yours is expired.

May 2002 He stopped attending school because he couldn't afford it any longer.

02/2009 Met hubby

08/2009 Sibling petition approved but ineligible to adjust status due to overstay

07/10 Married :)

11/22/10 [day 0]- mailed AOS packet!! should be there by noon 11/23/2010

12/3/10 [day 11]- received email/text notification of acceptance from USCIS

12/3/10 hubby surprised me with a trip to Los Angeles for my birthday...no problems :)

12/6/10 [day 14]- received hard copy NOA1 in mail

12/7/10 [day 15]- checks cashed...ouch

12/15/10 [day 23]- rec'd biometrics appt set for Dec. 28th at 10 am! :)

12/28/10 [day 36]- successful biometrics appt

01/27/11 [day 66]- rec'd interview appt set for March 10th at 10 am :)

02/25/11 [day 95]- rec'd EAD

03/10/11 [day 109]- Interview, Green card approved!! :)

Next Step: Removing conditions in 2 years.

Several points:

1) Your expired Malaysian passport (including the I-94 inside) is exactly what they want to see at the AOS interview!

2) You can't return to Malaysia to get a new passport as you will need a current Malaysian passport in order to fly to Malaysia. Again, you need a new passport to fly to Malaysia to get a new passport. Doesn't work. Understood?

I therefore believe you misunderstood the consular people.

Germans, too, can't get a new passport if they are out of status. Once they have a Green Card and thus can prove they are legally in the US, they'll get one. I believe it's the same with other countries, Malaysia included.
