Timeline

Please see this timeline:

Married in Kosovo in 2008

Wife arrived in the USA on K3 visa in May 2009

Filed for USA Marriage in June 2009

Wife went back to Kosovo in April 2010 and received her I130 approval, received Greencard on April 2010 at POE in NY

Wife's greencard expiry date is 04/2012

What options do I have? Based on the fact that she entered the USA on her K3 Visa before her I130, can she apply for citizenship the same time that she applies for removal of conditions?

Timeline

She will be eligible for citizenship after being an LPR for 3 years. She can apply no earlier than 90 days prior to the 3 year GC anniversary. When did she become an LPR?

Timeline

No, Removal ov conditions has to do with time as an Immigrant. A K-Visa holder is a NON-Immigrant until they adjust status and are approved for a green-card one with conditions or one without. (LPR status begins when the green-card is approved (04/2010), NOT when first entering the USA as a NON-Immigrant)

Need to file I-751 within 90 days before the card expiration, and can file N-400 1 year later, (Within 90 days before 3 years of LPR status)

Timeline

She entered on a K3 but never adjusted status and never became a permanent resident. SHe became a permanent resident when she entered with her I130 and got a green card

This will not be over quickly. You will not enjoy this.
