Timing Question

Our 90 days open April 15th, I was just wondering how important it is that we apply that day? Also if sending it say 2 weeks later will make a huge difference?

Also not that anyone will know for sure, If a government shutdown happens should we still send in our ROC or will it make any difference to wait until everything settles down. I know that the last time the government shutdown happened, the government was shutdown for 3 weeks, so that would affect us if it happens for any length of time.

My understanding is that the USCIS would not be impacted by a shutdown because they are self-funded. So definitely still send yours in. I don't think it matters if you send it two weeks after your 90 day window opens as long as it's within 90 days until the expiration date.

It doesn't matter if you send it two weeks after the 90day window, just as long as it is sent within the 90 days. I wouldn't wait too close to the end though.

Our 90day window opened on Feb 10th and we sent everything on the 23rd.

Thanks for the quick replies. I didn't think 2 weeks would matter, but just needed some reassurance.

As for the shutdown, I thought that it wouldn't affect USCIS as they're self funded but I heard otherwise.

What matters is that you got married to one another within the validity of the I-94, which incidentally is 90 days after issue. Filing for AOS can be done at a more casual pace, although if you wait until you've been married for 2 years in order to avoid the dreaded ROC process and associated $590 charge, be prepared to concurrently submit an I-130 which carries a price tag of $420.

It doesn't matter when you send the ROC package in after the 90 day window opens. We sent ours in 60 days after the window opened.
