Child Support not Counted as Income or Asset

I don't know why I posted this but am courious as to why when a wife leaves her husband and children (abandonement) and there is no way to reconcile but divorse, I get full custody of the children. To make it short. I presented my Attourney with a current statement of Arrears in the amount of $9,800.00 Owed to me. She handed it back to me and said: That don't count, she never pays you anyway. I agreed and said yes. Child Support never goes away if you owe. But, Then I asked: What if I was a Female Petitioner and getting Income for Child Support? No Answer... I'm just Courious behind the Logic of this.

Child support is counted as income if you are receiving it. If there is no payment from it you can not count it as income. You need another lawyer too, if he/she feels there is nothing to be done about the arrears. You can sue your ex in small claims court for the arrears of $10,000.

Child support is counted as income if you are receiving it. If there is no payment from it you can not count it as income. You need another lawyer too, if he/she feels there is nothing to be done about the arrears. You can sue your ex in small claims court for the arrears of $10,000.

Thanks for they reply. I'll never see a dime. So it is not countable for our petition as I assumed as well. Child Support will no longer accrue since of our 2 boys the oldest is 23 now and not in school and the other son died 5 years ago. (She never went to the Funeral) Men aren't always the bad parent. She had another daughter by another man and abondoned her too. I never really counted on her anyway. Cheating wife, drugs, bad friends of influence but she in the end made her own decisions and ruined her life as well as others. The boys were 2 and 4 years old when she walked out the door and never came back. It has been 19 years since I divorced her.

Many States will revoke Drivers' License for Unpaid Child Support. I know Illinois ha a Child Support Enforcement Agency. Further a family/divorce lawyer can get your arrears either through Garnishment or seizure of assets.

Many states will also revoke business or professional licenses, which I always found really strange. Let's punish someone who doesn't pay their child support by making it impossible for them to earn a living. :wacko:

Anyway, most states also report the arrears to the federal government through URESA. After that, the indebted parent can't get a passport or leave the US until the debt is paid.
