Please Advise ..... We are unable to sleep ....Our AOS interview messed up

Update..

we received Notice of Intent to deny (NOID)on April 25 which USCIS listed almost 5 discrepancies as a reason and told us to send us response which could overcome the facts. Discrepancies included two discrepancies regarding children issue which attorney told us are significant. One I have told right date of births but i have told them age are 11 and 14 while true ages are 13 and 14. second I my wife said I did not meet while I said I met .

In affidavit My wife had explained that It was a small meeting and it was more than year ago so she forget and since they are not living with us so we never thought that kids have anything to do with our new life and its issues. any ways. We send affidavit to them with a lot of new evidences. We have explained the reason for rest of discrepancies as well with pictures and letter. Our attorney told us to fill for hardship letter as well as precaution which cost us 587$

we have included following new evidances

---facebook chat of my wife and my brother almost 100 pages from last year

---One year call records of me and my wife and I have high lighted our call to each other which is every day

---affidavit from my family , her coworkers and her family (6)

---black and white prints of our pictures ( she upload them on her Facebook so actually face book pages, they have upload date as well camera date and comments from friends in old dates) almost 100 In our first application our attorney had added 2 pics only so ..

---copies of our cards

---bank statements of our bank account

---our e-cards to each other

---Our facebook pages and history of wall

---Call records of My dad phone from my home country shows he call her

---e-mail corresponds of my sister and my wife from last year

---gift cards and receipts of international gift used by wife to send cakes or cards to my brother last year date

---some junk mail etc

my attorney says she is very hopeful but i am worried still.

I want to prepare for worst while hoping for best

????please any body knows what if they deny the case what are my options if they stat that we have not overcome the discrepancies??????

This is the sort of evidence someone would submit to get a visa for their fiancee or spouse who is living in a foreign country. This is not the sort of evidence you would submit to prove you have a marital relationship with a spouse whom you live with. It's almost like your attorney is trying to prove you actually don't live together as husband and wife.

Please tell me this is a different attorney than the one who went to the Stokes interview with you... :unsure:

08/18/2010 - AOS Interview - APPROVED!

05/01/2013 - Removal of Conditions - APPROVED!

This is the sort of evidence someone would submit to get a visa for their fiancee or spouse who is living in a foreign country. the other 3 question were

when she asked how many lamps we have , what is colors of shade and body of lam, what is location of lamp and what material lamp made up of

we have same answer for all except i said lamp is made up of matel and she said it is ceramic. we have send picture of lamp to show it is made up of matal base and ceramic body.

2nd question

when she said name and location of biological dad I told her correct name but did not tell her where he lives we have answerd that his biologicald dad divorced her mom when she was 3 and she have met only 2-3 in her whole life he is not part of our life she even dont have address.

when answered regarding employment where she work, how long she is working there , what are her timings etc. our answers match except she had not indicated that she has variable timings.I told them same time of work but i had also indicated that her timings last month was different. we had add a letter from her employer which show her time scheduled and we explained that she had not indicated previous work timinigs but we have told them same time of work for that month

her facebook messages with my brother and sister indicated ( if she read) that we are living together She discuss our every day life with them.

Our phone records shows that as husband and wife we call to each other

Our face book shows that our friends knows us as husband and wife. when we go to watch movie or eat outside we check in facebook as well which shows we were together in particular picture.

she upload our pictures which shows we are togather on the same day she takes pictures and many times her friends comments about what we were doing together in picture. face book date is indication that we can not modify date on facebook. like our marrage day picture shows our marriage ceremony, date of marriage which is 2009 both on pic as well as facebook date . Our friends have congratuated us on those dates.

she is different attorney her profile has indicated that she has worked in USCIS as well as her co boss has worked 20 years as immigration attorney

I have spent 2500 on this attorney for all that.

It seems like english is your second language, which inevitably means you have some difficulty with using the right vocabulary and composing basic sentences. I wonder if the language barrier either in terms of how the IO comprehended your answers or how you phrased them had anything to do with the mismatch in answers? If this is true, you/your attorney may want to mention this extenuating factor in your response to USCIS although I doubt it would count for much. Still its worth a shot if possible.

Nov. 5: Sent AOS Package

Nov 17: AOS received by USCIS

April 1: INTERVIEW DAY. Approved!!!!!!

Early June: Moved to New York City. The only relevant city in the world ;)

We are extremely thankful to all members of forum who advised us in different ways as we tried to incorporate all positive advice in our response we are especially thankful to JimVaPhuong who has given us some of very useful suggestions for the response. As every one knows that INTENT TO DENY was a very serious thing but we were able to come out of stress with the help of our attorney , forum and THE ALLAH.

Wow.... what an excellent result..... I'm so happy for you!!

I've been reading your case since the first post....iI didn't put in any replies, as I had nothing useful to contribute!

Although my immigration was pretty straightforward, it was still a very stressful time for me....I can't imagine how many sleepless nights this has given you.
