I-129F/K1/NZ Fiance/Docs Not Sent

This is our situation so maybe I can clarify everything if possible.

My fiance has posted a question here but it has been added to in bits and pieces.

Here it goes;

  • We have known each other since primary school.
  • In late 2009 we met again online
  • She and later her 20yr old daughter have been traveling to Florida since Oct 2010.
  • We have essentially been living together with her returning to NZ every 90days.
  • On their last return via San Francisco they were detained for 5 hrs and threatened with denial of entry.
  • On Valentines day (Feb 14th 2011)I finally proposed to her.... She accepted. :)
  • We sent the I-129F Petition off early March and it returned due to a post office error.
  • The same day (March 24th 2011) I re posted it along with the G-1158 and payment to Texas.
  • Friday April 1st (LOL) I received email notification that it was received and forwarding to Vermont for processing. (Receipt #issued)

The issues are do we send the supporting docs, i.e.

  1. G-325a,
  2. I-130,
  3. copies of my birth cert & divorce decree,
  4. passport photos,
  5. letter of intent and
  6. proof of relationship etc.
  7. Or do we wait for Vermont Center to send me an I-797?

Any help?

The original packet contained:

1. I-129F K-1 PETITION.

2. G-1158 EMAIL NOTIFICATION REQUEST.

3. PAYMENT. CHECK FOR $340.00

It was received at the Texas lockbox and processed through to Vermont where they will issue an I-797 within 7-10 days.

We did just that same thing. We sent a COPY of our entire packet with our NoA1 on top to the service center with the hopes it would be matched up. They approved us, and I know there is NO way they would have without ANY documentation. So... it's worth a shot.

If your stuff doesn't get matched up, then at least you tried and you're only out the $5 postage to mail the packet copy to them.

You don't need the Proof of Relationship at this stage. Just proof that you two have met within the last two years.

Where did you send your missing Documents with your NOA!?

The Texas Lock box or the Vermont Service Center?

Mar 2011 - After 5mths denied for lost docs - Attempts to follow up failed. Mar 18 2012 - I-129F sent - No sign of NOA1 but they have banked the check...Jul 24 - Update - USCIS has located our file
Infopass Apt - they sorted through everything - our 2011 and 2012 file keep getting mixed up - getting us a Case# (still waiting) Dec- Infopass Appt- expecting to get a case # in about a week ..Still no Case number

Mar 2013 Infopass - advised file was in a box somewhere,and it would be quicker for us to refile. Life gets in the way... New petition submitted July 2014 .

Actual evidence of being in the same country at the same time is required to get the petition approved but says nothing at all about your relationship except that you met the requirement of being together in person during the two years prior to filing the petition. Primary evidence of meeting consist of passport stamps, boarding passes and receipts in country.

Evidence of a bona fide ongoing relationship is about the "relationship" not about the "meeting". It could be photos together, evidence of how and how frequently your communicate and evidence of how often and for how long you have actually spent time together in person.

Facts are cheap...knowing how to use them is precious...

Hello, how important are ATM/food/movie receipts to send along with the 1-129f for the proof of having met in person? ATM/food/movie receipts dont have names nor account number on it. Only the transaction no., the amount and date... Would that do justice at all? I am just curios since we did not include ATM receipts when we sent in our 1-129f.
