dual citizen trying to file for k-1

Hello everyone. I'm in the process of sending my I-129F package and i'm on the last leg of finishing the package. My question is, I'm a dual citizen. I'm a filipino Citizen and an American Citizen. I was born here in the United States but since i went to school over there in the Philippines, i became a dual citizen. Will this by any way affect my petition? I'm basically using my American Citizenship all the time but i do have a philippine passport. And i have about 3 stamps on my philippine passport. should i include that in my proof of being together or will it just jeopordize my filing? All i have is my philippine passport and nothing else to support my dual citizenship. (i don't have the certificate of naturalization because it was lost in a flood.) Thanks.

You have to be a USC to petition for a fiance visa, so what do you think?

Shouldn't be an issue. I am US&Canadian, have passports for both, filed 129F no problems. They only care if you are a US Citizen.

So what's your question? Are you wanting to petition for a fiance/e but you don't have proof of your American citizenship?

Is this the key question - will the USC's showing a Philippino passport with entrance/exit stamps as proof of having met within the last 3 years affect filing the petition as a USC?

Or are you saying you don't have ANY proof of your US citizenship - no passport, certificate, nothing?

I didn't even think of that point. CBP prefers US citizens to enter the country on US passports. But I guess you can't present what you don't have. At any rate, getting a replacement natz certificate would allow you to apply for a US passport.

It shouldn't affect the petition at all as long as you show CLEARLY you are a US citizen. Don't you have a US passport?? If not how can you prove USC???

If you were born in the U.S., then you are a U.S. citizen. Your U.S. birth certificate is all you need. You can obtain a certified copy of the birth certificate from the vital statistics bureau in the State where you were born.

Why would they? the US doesn't recognized other citizenship, as long as you present proof of being a US Citizen thats all is needed for your application, your Philippines citizenship has nothing to do in this process. Remember when entering the US you will need your US Passport, not the one from the Philippines.

Having dual-citizenship wont affect your petitions, the USCIS doesn't ask in any of the forms to list other citizenship, only proof of being a USC and you good to go.

Yeah, I can't think of a reason the USCIS would requir additional proof of your PI citizenship, and I guess (but I don't know for sure) that if you include a copy of your bio page and relevant passport pages from your PI passport that this would be counted as primary evidence, as long as the dates on the stamps fit within the previous 2 years of filing... even though the US doesn't recognize additional citizenship, I can't imagine they'd write off passport stamps in another country's passport as 'unofficial'... but I'm just guessing... sorry!

Allright. Thanks for the input everyone. I have another question but really off topic. How do i prepare my package to present to USCIS? by presenting I mean do I make it like a book where I write numbers on all the pages and make a table of contents? and i've read that i should two hole punch the whole thing and use a ASCOS fastener. Can someone give me a site or a reply on how to prepare the whole package. (I have all the documents i need already, i just need to put them in order. And i have a cover letter that i used from this website and i followed that) Thanks for all your help. I hope that when i'm done with this, i could help others as well going through the K-1 process.

There is no formal way to do this, but use paperclips or fasteners for documents that come in sets if you really want to.

You don't have to number everything but a cover letter that works kind of like a table of contents I think is appreciated. It makes the USCIS' job easier than if they're digging through a pile of paper looking for a foreign birth certificate and elsewhere for the accompanying translation, for example.

I've heard some folks use sticky flags to identify the different sections/documents.

In any case, a binder is not necessary, and staples are discouraged. The rest is pretty much up to you.

Hi. had another question. My I-129F package is about 1- 1 1/2 inch thick. Is that ok? the thing that makes it so bulky is the proof of relationship and ongoing relationship.

It's okay - I've heard worse.

Just remember to get tracking for it when you send it to Texas so you know it was received.
