we are still confused which one to file if K1 or IR-1/CR-1...

please help us with certain questions:

1. which process is faster k1 or the ir1/cr1?

(we are still not married, still thinking if we'll get married in the philippines or us?)

2. isabelle(beneficiary) have a 5 year old son from a previous relationship and will be joining her to US...for ir/cr visa, should we need to file a separate petition for him or just write his name on isabelle's dependents like in the case of k1?

3.if ever we get married, does isabelle need to change her passport with her married name into the family name to start of the IR-1/CR-1 petition?

04/07/2011 - NOA1(email notification)

04/11/2011 - NOA1 hardcopy received

07/11/2011 - NOA2 (email notification) yey!! approved!!

08/09/2011 - received mail from NVC w/ MNL case #

08/15/2011 - US Embassy manila received my file from NVC

08/23/2011 - paid at BPI (k1&k2)

08/24/2011 - scheduled interview via call center(interview sched sept.26 @ 6:30am)

08/25/2011 - received eligibility letter from US embassy

08/31/2011 - rescheduled interview appointment to earlier date (got sept.12 @ 6:30am)

09/01/2011 - 1st day of medical @ St.Lukes (me&my son)

09/04/2011 - 2nd day of medical (and yes!! we passed!! got our vaccines & xray cd&vacc. records)

09/12/2011 - interview...... APPROVED!!!!!

09/30/2011 - got our passport with visa!! yey!!

10/04/2011 - attended guidance & counseling at PRISM then went to CFO for the sticker......bought our tickets!!

10/12/2011 - flight going to SFO!! finally!!

10/26/2011 - applied for SSN

10/29/2011 - got my SS card

11/28/2011 - got married.. :)

12/08/2011 - changed my name on my SSN

12/12/2011 - received my new SS card with married name on it

12/31/2011 - mailed in I-485 (for me and my son) and I-765 via USPS to Chicago lockbox

01/13/2012 - received 3 email and text notification for AOS and EAD

01/18/2012 - received NOA1 hardcopy thru mail

01/21/2012 - biometrics appointment letter recieved

02/14/2012 - biometrics 11am for my son and 12noon for me...

Posted times by USCIS are the same, 5 months after submission before you hear anything. CR-1 has processing steps at the NVC.

2. isabelle(beneficiary) have a 5 year old son from a previous relationship and will be joining her to US...for ir/cr visa, should we need to file a separate petition for him or just write his name on isabelle's dependents like in the case of k1?

Separate petition must be filed if doing CR-1.

3.if ever we get married, does isabelle need to change her passport with her married name into the family name to start of the IR-1/CR-1 petition?

Whether or not she changes her name at all is completely up to her. Name in passport must match name on paperwork.

July 26, 2011: Received NOA2 via text/email!!!
July 30, 2011: Received NOA2 hardcopy in mail
August 8, 2011: NVC received file
September 1, 2011: NVC case number assigned
September 2, 2011: AOS invoice received, OPTIN email for EP sent
September 7, 2011: Paid AOS bill (payment portal showed PAID on September 9, 2011)
September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)
September 14, 2011: Emailed IV package
October 3, 2011: Emailed checklist response (checklist generated due to typo on Form DS-230)
October 6, 2011: Case complete at NVC
November 10, 2011: Interview - APPROVED!!!
December 7, 2011: POE - Sea-Tac Airport

September 17, 2013: Mailed I-751 to CSC

September 23, 2013: Received NOA1 in mail (receipt date September 19th)

October 16, 2013: Biometrics Appointment

January 28, 2014: Production of new Green Card ordered

February 3, 2014: New Green Card received; done with USCIS until fall of 2023*

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

i see you changed course from k1 to cr1...congratulations on your wedding...if you dont mind may i ask what made you decide to change you plan (from k1 to cr1)?

regarding her son... you said separate petition must be filed? so it means from the start at the same time with isabelle?

Yes, if you marry and file for the Cr-1, 1 petition for your (then) wife and 1 for the child

We went CR1 because it is cheaper, you can travel and work automatically, and it is 1 fewer step not having to deal with adjustment of status
