Hi there I was wondering if i could file for this?

My I-130 that my mohter filed for me (F2A catagory) is still pending CSC

If this is approved...and I wait till my PD becomes current which I understand will take a while

due to the retrogression situation...can I file for my I-485 and I-765?

Am I eligible to file for this? What are the requirments I dont quite get the USCIS descriptions.

Is there a better time to file this?

How long is the wait time, i hear it comes pretty quick (before I-485 ever even gets approved)

If you need more info for better answer Ill be happy to provide it :)

8/01/2010: Moved in together at his parents

5/29/2011: Asked me to marry him :)

7/01/2011: Started renting my sister's guest room together

7/14/2011: Got married officially

USCIS

10/26/2011: sent I-130 I-485 and I-765

11/02/2011: received Email USCIS Acceptance Confirmation for I-130 I-485 and I-765

11/03/2011: received NOA1 for I-130 I-485 and I-765

11/23/2011: Biometrics appointment for I-485 and I-765

01/09/2012: Recieved EAD in mail

02/08/2012: Interview Date (APPROVED!)

your ability to file for Adjustment of Status while in the USA will depend on your legal status at the time when the application was filed.... So in short you must be legally present in the USA... so which is it..?

If you care legally present and not overstaying a visa etc. when your priority date becomes current then only can you apply to Adjust Status using the necessary forms.

since the I130 is still pending you have a long time to go from AOS.

what is your priority date..? when was it filed..?

with what type of visa are you legally in the US at this moment? a student visa?

no you cannot adjust in country until the priority date is current. whether you go through consular processing or are able to adjust in country because you are here on a student visa or some type of visa, you still have to wait years until the priority date on the visa bulletin is current.

the i130 might take only 5 to 7 months to be approved, maybe more. after the approval of the i130 come the waiting in line.

when can your mom become a USC?

no, the work permit comes in the adjustment packet, when the priority date becomes current and if you are elegible to adjust in country.

And RICARDO my case was filed recently so i have no hish expectations of anything coming in soon.
