No 1 here on VJ is going to tell you to do something Illegal! Your a big boy, you know the risks.

Canadians Visiting the USA while undergoing the visa process, my free advice:

1) Always tell the TRUTH. never lie to the POE officer

2) Be confident in ur replies

3) keep ur response short and to the point, don't tell ur life story!!

4) look the POE officer in the eye when speaking to them. They are looking for people lieing and have been trained to find them!

5) Pack light! No job resumes with you

6) Bring ties to Canada (letter from employer when ur expected back at work, lease, etc etc)

7) Always be polite, being rude isn't going to get ya anywhere, and could make things worse!!

8) Have a plan in case u do get denied (be polite) It wont harm ur visa application if ur denied,that is if ur polite and didn't lie! Refer to #1

This may seem surprising, but there are actually very few regular VJ Canadians who have adjusted status as a visitor. The vast majority of US moved to the USA on a valid visa. The few individuals who did adjust their status did so because circumstances changed after they went to the US on a visit. I can't point out one single user who did what you are suggesting, so your quest to find first hand experiences may be difficult.

I agree with Flames. There are risks, and you are already aware of them. If you want to take the chance, then take the chance, it's your decision.

Our intentions are good - no one would want you to do something which could potenially result in a ban of some type (and yes, they do happen for real). There probably are a few people who have gone the route you're proposing unintentionally or intentionally and they can comment for themselves of course.

The main idea to come away with is that USCIS is not to be messed with. Get on their bad side or on the borderguards bad side and you're in for a long haul trying to explain your way out of your situation and fix it.

Folks are trying to warning you off before you 'try' an approach which has a high likelyhood of encountering some sort of problem. We all get how much people want to just get married and get life moving, immigration is a big PITA, but one which must be dealt with sensibly.

If you've been going back and forth for 3 yrs already what's one more yr ( possibly less) to file for a K1 and get it done the right way instead of running the risk of getting caught doing something illegal?

An older, wiser member posed a hypothetical question in the following situation:

Say you drive up to the border as you've always done in the past, and this time you get a few more questions than usual. Because you're a good person, you tell the officer, truthfully that you are traveling to see your boyfriend/girlfriend. In follow up questioning, you say that you don't really plan to come back because you've decided to get married and settle down in the States.

Now, do you think the agent at the border will let you through? Because we all know just how that scenario would end, we're going through the painful separation and expense of filing for K1 and IR1/CR1 visas.

April, 2009 - We met

May, 2009 - We wooed

June, 2010 - We got engaged, looking forward to a small August 2010 wedding

I have to agree with everyone on here, you are fully aware of the consequences of doing such a thing, so don't be surprised if nobody suggests you go through with it. Especially since *most* of us have gone the right way and waited a while to be processed, especially with Montreal.

Have I ever thought of finding a quicker way through this immigration process? Of course, who hasn't?!? But at the same time, we were really serious about spending our life together, and doing it the right way so we don't run into any problems in the long run. The AOS process is not a piece of cake and it should be taken seriously too....

Maybe you guys should reconsider your living situation... If you are not able to sacrifice several months to get a valid visa and do it the right way, then maybe it's not meant to be.

Not trying to be rude or anything, but I doubt you'll get different answers on here than the ones you got in the other forum. Good luck with everything, no matter what you guys decide to do.

Hate to sound like a broken record, but I full agree with everyone here. If you want to take the chance, no one is going to stop you but no one is going to be all for it either. I think Udella said it best, you must be sensible with this stuff! Love is not a very emotional thing, but unfortunately for cross border love, we also have to wear the sensibility hat and be forced to live apart temporarily.

We all did the long distance thing, we all know how hard, frustrating, expensive and disheartening it can be. If you can't make it another 8-9 months apart, then I don't know what to tell you. Marriage is no cake walk, that's for sure and our time apart has only made us stronger.

Hi,

From experience, I can tall you that the process is stressful enough when you're doing everything legally. I can't imagine the stress if you had something to hide. It's just not worth it -- you have too much to lose. Doing it legally is short term pain for long term gain.

If you really think about it, do you really want to risk being in a situation where you have to sit across a desk from a U.S. government official and lie to their face? And then get caught in that lie and be deported? Do you want to risk being turned back at the border and being given a multi-year ban from entering the U.S? Is your fiance/husband going to want to move to Canada because you are no longer able to move to the U.S.? If you think about it that way, it's much faster and cheaper to do it legally.

Like JustBob said, it sounds like the CR-1 might be a good route for you. Best of luck to you!

Have to agree with all above... No one is going to advise you to do anything illegal. I suggest you do a k-1 or cr-1 and visit during the process.

I also have to agree with everyone here. Take the time and do it the correct way. I realize that it might feel like it takes FOREVERRRRR for it get approved, but the results are well worth it. My husband's visa took longer than normal, almost a year and a half in total. However now that it's approved and he's here with me everyday, I wouldn't trade that for anything.

There is something to be said about the peace of mind you will receive knowing that you did it the right way, no matter how long it takes.

When I was new to this site my first post I made was asking what I had to do to be with my US fiance. I was clueless with the whole process and was unprepared for how long everything would take. I read some stuff but was utterly confused so I posted on here asking some questions.

I got jumped all over by one person in particular who told me that it was people like me who screwed everything up for everyone else.

I almost never came back to the site. Instead I lurked the forums and read and reread the guides.

I'm glad I stayed because so many people on here have been great and supportive of what I'm going through because they are going through the same thing.

My point in all of this is that I understand how overwhelming the wait seems, everyone on here does.

But you have realize that you don't want to take any chances on this.

I personally want to make sure all my bases are covered however frustrating that may be.

I would never want to run the risk of doing something that would potentially have consequences later on that involve me being denied or separated even longer from my fiance.

I've learned from this process how particular and strict the USCIS really is.

I know the wait sucks, but theres no easy way around it.

You don't want to take risks when it comes to being able to be with your husband.

We filed for a K-1 visa and I think I finally see the light at the end of the tunnel!
