Hi! I Came here in the U.S with a k1 visa and got married within days but haven't applied for adjustment of status right away, my I-94 form expired couple months ago. Anyone know the requirements for applying adjustment of status for my case? do I need to have medical exam here? and Is the payment the same with those who applied on time?

You will have to file for AOS asap (you are currently aquiring out of status time).

Follow this guide.

If your more than a year from your K-1 medical - you will have to re-do the entire thing.

Your costs will increase most likely - since you have to fill out more forms. (I-130 in paticular)

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

Why are you telling the OP they need to file an I-130? The married within the 90 days and they haven't stated that it's been more than 2 years since she arrived, just several "months".

First, you will require a new medial if it's been more than a year since your K1 medical was done. If it has been TWO years since you got married, you will need to follow the guide quoted above.

Hi...we have same situation! I'm 1 year now here in the US and just got approve for my gc yesterday. :dancing: my I-94 expired June last year and applied for AOS Dec. my medical expired feb this year...but everything went fine! your medical will depends on the sheet that you have. I can give you the requirements...:)if you want to leave your email..:) goodluck..

No you don't.

Vanessa is correct - I misread your initial post and thought you were pass the point for the normal K-1 AOS.

I did not apply sooner because of our financial problem.(my husband's hours at work were cut)...:( I was scared that because of many months delayed for applying our AOS will result bad for my gc but thank God my interview was so easy...was not ask why it took as long time to apply..as long as you have all the documents to show them you are fine :yes: pm me if you have any more question, I'll be glad to help... :D
