Hello everyone, Just a quick questions and its kind of hard for me to really find out what's going on.

I have filed for my AOS Nov 12th 2010. Biometrics was on 1/26/11. Already received EAD and AP.

It's been about 1.5 months since biometrics and I haven't received any interview letter yet. I have called up USCIS and spoke to the customer service there and the lady told me that the I-130 could take up to 5 months and the I-485 could take up to 1 year. She said that my application looks good and is "pending".

I just find that a bit odd since most people on VJ seem to get their interviews within 3-4 months of filing.

I am wondering if anyone on VJ lives in the NYC area and what the most common timeline is like.

7/20/09 - When we met
9/16/09 - When we started dating
1/15/10 - Moved in together
9/3/10 - Marriage
11/10/10 - Filed AOS at Chicago lockbox
11/12/10 - AOS package received
11/17/10 - NOA1
12/27/10 - Biometrics --> canceled due to snow condition
1/18/11 - Advance Parole approved
1/26/11 - Biometrics Completed
1/31/11 - EAD in production

Hopefully I am the exception and not the representation of the NYC cases. I had to get Congresswoman involved to get the interview letter. Some NYC people who filed around August 2010 also faced delays compare to the other locations but pretty much everyone had the interview letter by late November. So about 4 months. So I'd say that if you dont get by early April, you may want to reach out to the congressman's office. Most of the people on the phone, even the second level IO are clueless about how long it takes. If you tell them that most people get it in 4 months, their response would be that 'every case is different' - BS!

One thing you need to do is find out where your application is in the process. One of the second level IO told me that my case was marked as 'Ready for Interview' as of Sept 3rd by the NBC. Surprisingly when I called later and spoke to another second level IO, they refused to provide me this info, in fact told me that no such info can be looked at by any IO. When the congresswoman's office reached out to NBC, they mentioned the Sept 3rd date again ... so its really hit or a miss when calling but if you can find that your BG check is done then there really shouldn't be a reason for them to delay.

How did you go about doing your walk in for the Woodside, NY location?

Waited for the actual Bio letter as it would have the location you need to go to - Brooklyn/Manhattan will probably be different, though some people have gone to a different ASC than what was in the letter. Showed them the Bio appointment letter, just said that I wanted to come in early and they didn't say anything. Worked out well.

I also live in Queens, Ny and applied on September 10 but have not heard anything on an interview. My wife received her biometrics within a month and her Employment Authorization card in November but we have not heard anything since. It has become frustrating as i see others are getting theirs before me even though i have applied before them. When i call that's all they tell me that every case is different and that we are on schedule. If you do go to USCIS office they show that current processing time for NY Office as of January 31, 2011 is August 17, 2010 which probaly would explain why i have not receievd anything as I'm in September. Still some of it makes no sense since i mention earlier that other people have already received their interview even though they files after i did.

They did tell me i should receive one around March or April. Hopefully this is true.

I think that every case is probably assigned to an Immigration Adjudicator. The speed of the process once the case gets to each individual office probably depends on the officers schedule. If she was sick then your case will be delayed, if she has vacation then your case may be delayed.

Dont worry about it.

My Wife Did a Walk-in there. they told her that she is not supposed to do a walk-in, but at the end they let her do it!

Does the EAD come any faster?

i guess it's early for me to say anything, depending on the timelines thugh EAD shouldn't take more than 70 days

but yea on the phone USCIS person probably just read the script in front of her, just ignore them, if 485 takes a year, i will involve even Obama lol

current timeline is 3-4 months it shouldn't be more than 5 months

Not from NYC (moving there this summer though) but the situation sounds bad.

In my opinion though, as long as you have your EAD and AP, you have all the essentials and in the very very worst case scenario that you have to wait for 1 year to do AOS (which I don't think will happen), you can always apply to renew the EAD/AP in advance of their one year expiration.

Yes, she was schedule for March 14 but she did a walk in on Feb 22. and the card is in production as of March 11. so we should be getting it by mail pretty soon

Well, I guess I am not the only one then. I wonder why this process takes so long in NYC. You would expect having more population = having more workers.

I will wait till April and if I don't hear anything, I guess I will have to contact the congress person involved.

BTW... what do you type when you write them a letter and such? Does it matter if the person is a republican or democrat? or it has nothing to even do with that?

Luckily, my wife is not working and don't plan to be working anytime soon... we just need the GC because we have to travel out of the country (to Canada) in August.

That is still 5 months away, but you never know.
