Hello fellow vj members,

I would appreciate all ur help with regards to my friend's situation. He came here 10 yrs. ago, got married ,had kids and all.He came here on a K1 visa.

When he filed his removal of condition,,he recevied a letter of approval from USCIS that his green card was on the way. HE waited for his Green card in the mail and until now he did'nt get the actual GC. All his kids were born here and are all USC by birth.

My friend thought it could have been lost in the mail. He tried to call the USCIS office and they said he had to apply again and pay again?

Now he's confused,,is he supposed to file again from step 1? He's now considered illegal here with no job, no SSN and no driver's license.

What advice can u give me for a very confused and good friend of mine?? Thank u so much in advance.

Sounds like he needs to apply for a replacement green card. http://www.uscis.gov/portal/site/uscis/menuitem.5af9bb95919f35e66f614176543f6d1a/?vgnextchannel=db029c7755cb9010VgnVCM10000045f3d6a1RCRD&vgnextoid=b3f7ab0a43b5d010VgnVCM10000048f3d6a1RCRD

Thank you,,that;s what i told him, but can he still do it though he was here for years without GC?? does he have to file for Removal again or just apply for replacement of green card which was lost and he never got it??

If he has received the approval letter (and still has it), he should submit a I-90 and pay fees to get a new green card. No, he is not out of status or illegal, he is a permanent resident.
