My fiance has secured a sworn affidavit from the father of her first child. They never married. He is on the birth certificate as the father. The affidavit states that he is giving my fiance full permission to take his daughter to the US for immigration purposes. She will have this at the interview.

She doesn't need it...

Follow the link in my signature, unless they were married the biological has no parental rights unless he pays to sue in court for them. The US Embassy in Manila know this well. Her CENOMAR will be very important to prove there was no marriage to the bio-father and that's all that will be needed.

Our little guy had his bio-father's signature on the birth certificate and even carries his family name, it didn't matter when it came to getting his Visa to move here. For the adoption this summer will need a letter from a Philippine attorney stating why there is no birth father who has any rights in this matter and a copy of any applicable law including translation.
