Just got back from our approved AOS interview. Was reading through a couple threads and noticed someone mentioning that anytime between the I-94 expiring and your AOS NOA1 date counts as 'out of status' accrued time.

Part of the questions included what I figured were 'have you ever been deported, detained by immigration, yaddy yaddy...' to which I answered no to all. My I-94 ran out October 7th and our AOS NOA1 was November 22nd.

Have I made a false declaration? I honestly don't know if I was specifically asked about time out of status. There was a lot of joking between the IO and the three of us about my daughter disagreeing that I haven't ever terrorized anyone and how many more questions there were compared to a couple years ago.

*facepalms herself*

The IO knows that you were out of status between the expiration of I-94 and filing for AOS.

Nope, we had a longish chat about my daughter's reaching 14 shortly after we ROC and how I should come back just before her 14th birthday, when I'm 6 months shy of 3 years' LPR status. That in these sorts of circumstances, they have some leeway about accepting citizenship applications earlier, to avoid unnecessary processing of the I-90 for her, considering she'll derive citizenship through me since she's under 18. I guess as long as I'm not approved before 3 years' and we're application pending, she's ok on her 'expired' GC.

I just don't want it to come back and haunt me... lol Read too many stories about things like people 'inadvertently' being signed up as a voter and then having problems.

You're fine :)

That questions doesn't say ask if you ever been out of status. It says have you been put in removal proceedings, deported, etc. You answered correctly. Congrats!
