Hi guys, am posting again with a small concern, well am hoping it's small :)

my husband had not filed his taxes in a few years but he did file the most

recent one. now that i was RFE'D for the 2007-2008 ones he had gone ahead

and filed those back taxes.

do you think the fact that he is just filing them will be an issue?

and what if he is owing will that affect my case in a negative way?

I don't know the answer to question, but I just wanted to remind you that your response to the RFE must be sent in before a certain date (usually 80 days from receiving it). Make sure you can get a tax transcript requested and sent back to you well before that certain date.

23/07/10 - Arrived in the U.S.

28/08/10 - Got Married

20/10/10 - Sent AOS

04/11/10 - InfoPass Appointment to request an Expedited AP

05/11/10 - Expedited AP Approved! RFE requested for AOS

01/01/11 - RFE Received

01/12/11 - Biometrics taken

I don't know the answer to question, but I just wanted to remind you that your response to the RFE must be sent in before a certain date (usually 80 days from receiving it). Make sure you can get a tax transcript requested and sent back to you well before that certain date.

...not sure if that was meant to be snarky or not.

Some people do fail to recognize just how important it is to get the RFE back in time, or underestimate how long it takes to procure certain documents. I was just trying to help.

no, you totally misunderstood me. i really appreciate your advice because i really did not

know that i had such short time span to respond to their RFE. so i appreciate it. no pun

Immigrations and taxes are two different issues. Did he file an extension for those years previously? If so, you should still be able to get the tax transcripts. If not, as long as he has filed (even though late) and is paying any fees and/or penalties it shouldn't be a problem with your USCIS app. In this case, you can respond to the RFE with copies of the tax returns as I would imagine you won't be able to get the tax transcripts in time. It will take probably 60 days or more just for the IRS to process the past tax returns.

Your RFE should have a date on it that it needs to be returned by. Just double check it - it may be shorter than 80 days.

Your RFE should have a date on it that it needs to be returned by. Just double check it - it may be shorter than 80 days.

actually they did not give me a specific time to return, and i was

wondering why they didn't since most people i have read about does

get a time to return.

they just gave me the blue sheet and told me to contact

them for a date when i get the documents. :unsure:

Hmmm I've never personally heard of that before, but I'm still relatively new to these forums, so you may want to direct that question to a more experienced member.

If it doesn't have a date, I would just suggest getting everything sent in ASAP - when you get an RFE, it stops your immigration clock. Basically it stops all progress on your application until you send it back in.
