NOID Crimes/Domestic violence

So I got this NOID asking me to fill out a form indication I have not ever been convicted of a crime etc. This form actually has a line saying "None apply" so fine I check it and sent it back. But what gives? The original 129 F Part C asks you to check a box if you have ever been convicted of this or that crime but does not have a box for "none" or "not applicable" or "for god sake I am a law abiding citizen". So why I have I gotten this NOID? This makes not sense.

Sounds like you used an old version of the I-129F, as the current one certainly has a place to check a box for "NO". If so, what you got was an RFE, not a notice of intent to deny. Of course, if you fail to respond properly to any RFE, your petition will be denied.

Facts are cheap...knowing how to use them is precious...

Sounds like you used an old version of the I-129F, as the current one certainly has a place to check a box for "NO". If so, what you got was an RFE, not a notice of intent to deny. Of course, if you fail to respond properly to any RFE, your petition will be denied.

HMMMM I checked the "example 129F on this site and it also has no place to mark no, and the notice clearly stated "Intent to Deny" but I did reply so hopefully that will take care of it and it won't cause too much delay. Thanks

The VJ example form is not the current form from USCIS, but it DOES have a place to indicate yes or no in part C, question 2. Did you check either of these boxes on the form you originally sent in?

12/15/2009 - K1 Visa Interview - APPROVED!

12/29/2009 - Married in Oakland, CA!

08/18/2010 - AOS Interview - APPROVED!

05/01/2013 - Removal of Conditions - APPROVED!

I got the same 1-797E, with a blue cover letter on the thing which said, "RESPONSE TO AN INTENT TO DENY", along with 3 pages of IMBRA boilerplate dealing with the criminal convictions part of IMBRA.

I went back and looked at the application I sent in, and lo and behold, I hadn't checked the box for Part C, Question 2. What is the sound of a single man kicking himself in the ####? Argh!

I looks to me like all I have to do is check the box in question 1 which says, "None Apply.", sign the thing and Priority Mail it in.

Question is: should I send in the passport photos I forgot to send in with the original application, or wait for a second RFE?

Yes, send in anything you know you didn't send.
