Can I apply for a new re-entry permit for my child outside America even she still have a valid one?

She's only 2-years old, has a green card, been staying at her mother in the Philippines since June 2009 up till now, but the problem is her valid re-entry permit is going to expire at April 7, 2011. Please I need some guidance right now, cause I don't want the USCIS to think that my daughter or me has abandoned her Permanent Residency. I appreciate the help... comments...

Not that I'm aware of. They are valid for 2 years. The instructions state that you have to apply for them in the US. I have heard of a returning resident visa as well.

From my view based on what you've said, she HAS abandoned her residency... well technically she hasn't because of the re-entry permit but I mean she's not maintaining residency and a 2 y/o has no need to be outside the US.. meaning no need to attend school/college, or a job in the Philippines. To maintain residency she needs to have filed taxes, or maintained her residence etc etc but she's a child so she can't do that. Maybe her mum has a g/c as well and a re-entry permit and you felt she would be better with her mum while her mum wasn't in country, that makes sense.. Maybe your family unit moved out of the Philippines for a while so I could be jumping the gun.

Anyway :D - have a look at the returning resident stuff, I don't know much about that so you'll need to read the instructions, but I do know that the instructions for the AP and re-entry permit state you need to be in the US to apply for them.

IF i were you bring her back to the US as soon as possible..PLS. the Re-entry permit just valid only 2yrs. she/he should go back before 2 yrs. PR can stay 6months outside the US no later than six months.Can i ask you 2 things. how long u been in the US? better f she stay with you.for the sake of her status..

Is the 2 yr. old a US citizen or just a green card holder? Pls... please bring him back to the US before the permit expires otherwise he won;t be able to enter the US again and u will end up filing a petition for the child again.
