Legally you should have been mailed your W-2 on the last day of January I believe. Anyways, it is not absolutely required until April 18th. I would send your application in now with paystubs to show current income. Then if they want more info they can ask or you can bring it to the interview if you have one.

This may not help, but I thought I'd share my similar experience.

I had this same problem, we got a RFE for not sending USCIS the 2010 forms.

I didn't think we would get our W-2 back in time so we photocopied the tax forms that we sent in for the 2010 tax year and then sent those in for the RFE. We're still waiting to get approved for AOS, but it seems they accepted the photocopy for the RFE.

My point is - I got a RFE for not providing the 2010 W-2. I would wait.

:o I hope we dont get an RFE I didnt send in my 2010 Tax either because at the time I didnt have them to file and I still have not filed....oh geez!!!!!

This doesn't make sense. The timeline in your signature says you got an RFE in the beginning of January. Very few people would have gotten their W2's by then, and even fewer would have already filed their 2010 tax returns. Also, how could you have already sent your 2010 tax forms to the IRS if you hadn't received your W2 yet?

Are you sure you're not talking about the 2009 tax forms - the ones that you filed in 2010?
