I came to the US as Student. My wife and I just got married and we are about to file for my AOS. I know that for the I-864 affidavit of support I need to attach her 3 most recent Tax returns. We had a problem with our mailbox and we haven't received her W2 from last year so we haven't filed her 2010 taxes.

My question is: is it ok if we send the I 864 with her 2009, 2008, and 2007 tax return transcripts since the 2010 tax is not due yet? We might have to wait for 2 more weeks to get her new W2 and I want to file for AOS as soon as possible.

Yes, that should be fine.

There is no need to submit the 2010 tax info at this time. Later when you do have the 2010 info you could take it to the AOS meeting.

They ask for a return for the most recent tax year. The most recent tax year is the one with the most recent filing deadline. Currently, that's the 2009 return, which was due to be filed on April 15, 2010. The 2010 tax return won't be due until April 18, 2011. USCIS won't require you to have a 2010 tax return until after that date.

Would I be alright by sending in the 2010 return?

I know it asks for either the last 3 or the most current, correct?

Yes, you can send the 2010 return if you've already filed it.

what if you aren't required to file any taxes, do you just send them your SSA-1099, and 1099-int, and DAV.tax exempt notice showing your income....which all of these goes why over the 125% level but do not require any IRS filing....i also have from tax year 2009, and 2010 exempt letters from the IRS....well they accept this under the I-864 as proof of income??

06/09/2011... Confirmed del at 11:10am signed by N visa center.

Good day My husband received NOA1 last Feb 14 and no further instruction yet,My question is how long he will wait the instruction from uscis that he will submit the affidavit of support?Is NOA2 come first before filling I-864? 90days was over. I really want to hear from the people who had same case thanks in advance.
