Is this a Red Flag?

Hi all, we have this situation and we don't know if this is a red flag or not. My bf and I known each other for almost 10 years now. We met on Yahoo Games thereafter we became constant playmate and became good friend. He was working as a Forex Day trader then while I was working as an Industrial Engineer. On 2007, he offered me to work for him as his assistant. I accepted the job and til now I'm working for him. Now, he is also working full time in one of the companies in the US while working on our forex trading business. So, On G325A I put my bf as my current employer. What do u think guys, would USCIS take this as a Red Flag. Wouldn't they think that we are using K1 just to get a green card so I can work in the US w/o going through employee visa? Which is faster to process anyways, Fiancee visa or Employee Visa? Pls help us. we are really worried about this. if you are in our situation, how would u justify that the relationship is bonafide?

Honestly, we would like to omit that info to avoid red flag but we bought thought we should state what are true because once USCIS make a background check and found out about it. the more problem for us. Besides, What we are doing now is for our future and I could still work for him even w/o going to US since our work is a internet based job.

Any reply is very much appreciated. Thanks in advance ya'll.

Mar 14 2011 - NOA1 received by email - petition routed to VSC

Aug 10 2011- unexpectedly received mail from NVC saying we are approved

w/ my MNL case # on it.

Aug 11 2011- My approved petition already at USEM :)

Aug 16 2011- Finally, USCIS update our status..

Aug 22-23 2011 - Medical Exam: Passed! yay!

Aug 22 2011 - finally received hardcopy of NOA2 on mail and we were approved since Jul 13, 2011

Sep 02 2011 - Interview date! approved!

Sep 14 2011 - Visa received!

Sep 19 2011 - POE (Guam)

Oct 14 2011 - Wedding Day

Nov 21 2011 - AOS Sent

Nov 25 2011 - AOS Delivered

Nov 30 2011 - NOA1s received by email/

Dec 06 2011 - NOA1s hard copies received dated Nov 30, 2011

Dec 22 2011 - Biometric done

Most employment based visas do not automatically lead to a green card. They're also rationed, so unless you've got a skill that would make it difficult for him to find someone in the US who could do your job then it's not likely he could sponsor you for an employment visa. If you even have to ask which is faster, K1 or employment visa, then it sounds like you really do have multiple motives here.

The fact that you are working together won't concern USCIS, but the consulate will scrutinize this to see if there is an underlying motive. Employment based visas to people in the PI have virtually dried up, and a lot of people are getting creative about finding other ways to get to the US so they can start working here.

You must not omit any information they ask for. If they discover the omission and determine that the information is material, then they'll deny the application. The US government generally understands an honest mistake, but they don't like it when you intentionally lie or hide information from them.

12/29/2009 - Married in Oakland, CA!

08/18/2010 - AOS Interview - APPROVED!

05/01/2013 - Removal of Conditions - APPROVED!

I think your appliation could be scrutinized more closely if you do not address it. If you have not already submitted the K1 application on the G-325A, I would list the name of your BF's company, not his name. Also, I would include a brief letter explaining how you met, when you started dating, when you started working for him as his assistant, and when you started the joint forex business with him. I would send it with both the K1 application and as supporting evidence for the interview.

@JimVphuong: Thanks for the reply. I asked which is faster, employment visa or K1 visa was out of curiosity :). We are just being critical over our application to avoid any red flag. You are right, just as we thought, omitting vital information will might lead us to rejection.

@reeses16 and Baron555: yes, we already created our time line, from the time we met online to the time he proposed in person. And yes, we have loads of evidences too. thanks for the reply...
