Hello Everyone,

Here is my situation.

I usually travel back to Nigeria every year to see my then Fiancée who was still living in Nigeria..

Last year January , we finally got married and now have a baby girl, who is the joy of my life..

Now that i am an american citizen, i have read somewhere that the best option is to file for IR-1/CR-1 Visa for both my wife and child. Can someone tell me if i am right and if YES, what are the forms and the proccess that i need to go through .My other question is Do i need to file a seperate form i130 for both my wife and daughter..

I NEED UR OPINIONS.

Thanks

Was your daughter born before or after you became a U.S Citizen? If she was born after you became a U.S Citizen, she's entitled to U.S citizenship and can obtain a U.S Passport. You can contact the embassy on this. If she was born before you became a U.S Citizen, you have to file separate I-130 for both your wife and the girl. Information about the forms and process can be obtained from www.uscis.gov

I hope this helps.

You file separate I-130 for wife and child. Did you naturalize before or after child's birth? If before, you may be able to get child's birth registered at US Consulate, and get child a US Passport, then no visa needed for child. If after, then should be able to claim citizenship for child after entry to the USA by filing an N-600.

http://www.uscis.gov/USCIS/Resources/A4en.pdf (Actually, it looks like you could claim citizenship for child, if born after you naturalized)

She was born before I became a US citizen...she came three months early

Then you will be filing an I-130 also for her, and then later can claim citizenship after she enters the USA.

Found this on the uscis.gov

  • Your child may qualify for naturalization if you are a U.S. citizen, the child was born outside the U.S., the child is currently residing outside the U.S., and all other eligibility requirements are met.

Note: You may already be a U.S. citizen and not need to apply for naturalization if your biological or adoptive parent(s) became a U.S. citizen before you reached the age of 18. See the “Citizenship through Parents” link to the left.
