K-3?

That petition process starts with filing an I-130 to USCIS Chicago Po Box, and the following it up later after getting I-130 Receipt letter by sending an I-129F to the center indicated on the I-130 receipt letter, with a copy of the I-130 Receipt letter.

That being said, What happens next will be USCIS tying the two petitions together processing them together, approving at the same time and sending together to NVC, where NVC will CLOSE the I-129F (K-3) and proceed with processing the APPROVED I-130 for a CR-1 Spousal Immigrant visa.

The reason the K-3 exists is no longer a problem. K-3 exist for one reason only, a very long I-130 approval process, K-3 was developed as an option when I-130 was taking YEARS to approve, the K-3 allowed a couple the ability to wait out the long approval process of I-130 in the USA. Since the I-130 is being approved not in years, and is approved at same time as the optional K-3 I-129F the K-3 no longer serves it function (WAITING for I-130 approval)

MORE:

How will the Department of State process my K-3 visa petition?

Important Notice: Effective February 1st, 2010, when both the I-129F petition for a nonimmigrant K visa and the I-130 petition for an IR-1 (or CR-1) spouse of a U.S. citizen visa have been approved by USCIS and sent to the National Visa Center (NVC), the availability as well as the need for a nonimmigrant K-3 visa ends. If the NVC receives both petitions:

  • The nonimmigrant K visa will be administratively closed.
  • The application process explained below will not be applicable and cannot be used.
  • The NVC will contact the petitioner and you with instructions for processing your IR-1 (or CR-1) immigrant visa. For more information on the immigrant visa process review the Immigrant Visa for a Spouse webpage.

If the NVC does not receive your I-130 petition and I-129F at the same time, the NVC will process your I-129F petition. Then NVC will send the petition to the embassy or consulate in the country where the marriage took place. If your marriage took place in the U.S., the NVC will send the petition to the embassy or consulate that issues visas in your country of nationality.

I would forget the K-3 and sinply file an I-130 for a CR-1 visa it WILL save you at least $1000 CR-1 gets green-card upon arrival to the USA, K-3 does not.

OUR TIME LINE Please do a timeline it helps us all, thanks.

No where! K-3 is closed at NVC and does not process anymore. Look at the CR-1 guide, CR-1 is processing faster than a K-3 because K-3 are no longer processed.

K-3 forms? they go to the Embassy, attn Immigration Visa Unit.

(this presupposes the approved I-129F was already sent out from the NVC to the Immigration Visa Unit at yer US Embassy/Consulate)

----

based on yer marriage date of 2010-12-05

you probably are solely interested to file for a CR-1 visa -

and that's ONLY the I-130, at this time, to USCIS.

Please read these two wiki pages, from top to bottom

http://www.visajourney.com/wiki/index.php/How_to_bring_your_foreign_spouse_to_live_in_the_US

http://www.visajourney.com/wiki/index.php/EZGuideSpouse

If you don't wish to read those 2 pages, would you at least find the proper guide (and disregard all references to K-3 visa) ???

Hi all I am trying to find where to send my K-3 forms??

Thanks so much.

There never has been such a thing as a K3 form, and the K3 visa is no longer available. CR1 is the currently available spouse visa for newlyweds. If you have any form you know you need to send, you'll find the instructions for what to send and where to send it on the form's instructions. If you didn't read those instructions carefully, now is the time to do so.

Facts are cheap...knowing how to use them is precious...
