My stepson is from Russia and just over the holidays traveled home and was married to his fiance. I thought I had read on the USCIS site that the processing times for these cases were in the 6 month range so we thought that perhaps within a year his wife could be here. Now I'm reading on this site that it's taking 4-5 years! Is this really the case?? I'm feeling terrible now as I told him it shouldn't take more than a year or so. He still has a little less than 2 years before he can apply for citizenship. It sounds as though it might still be faster get his citizenship first. Does anyone have any updated info on this subect?

US citizens applying is no doubt faster, because they are a US citizen.

Your I-129f was approved in 5 days from your NOA1 date.

Your interview took 67 days from your I-129F NOA1 date.

AOS was approved in 2 months and 8 days without interview.

ROC was approved in 3 months and 2 days without interview.

According to recent January Visa Bulletin F2A category will take 3-5 years as of Visa waiting list. DOS is not giving the annual visa limit that they have promises on their website. I have applied for my wife 2 years and 9 months now. and Also case has been completed at National visa Center. According to January Visa bulletin, it is Uncertanity for wife's visa processing.

I would suggest you apply for I-130 and let it process at USCIS service center, then upgrade your application from LPR to IR1 when he become US citizen. I believe you will save atleast 1 year.

Sounds like a long wait no matter how you go about it. And here I thought the 7 months it took to get his mom over here on a fiancee visa was a long time! I'm wondering if it would have been better for them to not get married yet but instead have him get his citizenship then get her over here on a fiancee visa as I did. I was told that even with citizenship it takes longer to get a spouse over here than a fiancee. I got that from the immigration lawyer that I used when I did all my paperwork. Speaking of lawyers, does anyone have any experience using an immigration attourney in this type of situation? I'm curious if using a lawyer might actually speed up the process any.

No lawyer can speed the process up for LPR filing for spouse - simple as - no visa numbers available - you get to wait until one becomes available.

Getting married certainly can't hurt him - by the time the visa number becomes available (hopefully sooner rather than later) he will have been in a marriage for long enough for his wife to get 10-yr green card and skip all the joys of removal of conditions.

Okay, probably a stupid question but one that I haven't found an answer to anywhere else yet. Is it possible for an LPR to marry a foreign visitor to the USA and then change their status?....I'm sure you know what I'm thinking about at this time. I didn't think it was possible but I'm not sure. I have to assume it isn't possible, otherwise I would think that a lot of others on this forum would have already tried to go that route.

LPR can marry any nationality and can also file for Green card too. As I mention it my prviouse post how much wait time will apply for LPR status.

No, adjustment of status (like you had with your wife) not possible - no visa number available - no adjustment of status. It used to be possible when the visa numbers were available in 6 months, by the time the I-130 is adjudicated the number was available and the option for AOS but that's no longer the case.
