ok....my wife was approved for her visa...we were going with the cr1...now she has been approved....our marriage date is jan 6 and it will be 2 yrs...we were married in china jan 6 2009 and she has not come to the us yet......should she wait till after the 6th of jan to go get her visa,,,or should she go now since she has been approved...i know if she gets it before our marriage date of 2 years she will get the cr1 right??....but if she waits till after the 6th to get her visa,,,can she just get the ir1,.,,is there anything special she will have to do to do this...or should she just get her butt to Guanzhou and get the cr1 visa...any help anyone can give I would be grateful..thanks...hoopy

I think she should tavel after Jan. 6 and inform the POE officer that she is entering the US after her 2 year wedding anniversary and should be issued a 10 year green card, regardless of the CR-1 visa in her passport

I think she should tavel after Jan. 6 and inform the POE officer that she is entering the US after her 2 year wedding anniversary and should be issued a 10 year green card, regardless of the CR-1 visa in her passport

Well she recieved her paper from the consulant in Guanzhou dec 25th and she was told to go to the office in Guanzhou on a monday or tuesday and get the process finished.,,we figured if she went on the 10th she could advise them we are married over 2 yrs since our anniv date is the 6th of jan for 2 yrs we are married.,,,or does it matter and she can change it from a Cr1 to a Ir1 when she goes thru the POE,,,thanks,,,hoopy507

I can be far more helpful to you if you'll answer the direct questions I asked you. Here they are again?

Is the visa in hand? On what date was it issued?

If the visa has been issued, it won't change. You simply delay travel until after you've been married two years or you don't. If you do, she is entitled to IR1 status upon entry even though the visa says CR1. CR1 and IR1 are both status and visa categories. CR1 visa holders who enter the USA after two years of marriage are entitled to IR1 status. Be sure to mention the two-year anniversary when entering.

If she enters before the two-year anniversary, she'll get the two-year card instead of the ten year card. You can control the entry date but not anything else. Telling the Consulate something AFTER they issue the visa will not have any impact. That's why I asked if the visa was issued. Has the visa been issued or not?

No she has not been to Guanzhou as of today and thats why I thought she could go after our anniv date of jan 6th...she does not have it in hand ...all she has is the paper saying she was approved and it was delivered to her on dec 25...thanks for your help....hoopy

Please use terminology that matches the question. I understand she doesn't have the visa. If the visa has been approved and they are waiting for her to take the passport in so they can issue the visa, sure, she can wait until after the anniversary and add a note telling them you've now been married two years. On the other hand, if she hasn't even had an interview, the visa won't be issued until after the interview anyway.

yes she has been approved...and she has to go to the consulant to get the visa...so seems she will wait till after our anniv. date on the 6th of jan and get the visa...so we will make sure they know we have been married over 2 yrs,,,was just basicly wondering if she had to wait to cross the POE to get it turned to a IR1 from a Cr1....thanks for all your help....hoopy
