I am confussed and very sad now. My husband was interviewed and was denied on November 29th, 2010. He received a white sheet of paper and this is what it said. The Foreign Service of the United States of America saying the following.... Dear Visa Applicant: We are returnign your visa petition the the Department of Homeland Security office where it was approved with our recommendation that the petitiion be reveiwed for possible revocation. Any further inquires should be directed to that office. The reasons are as follows: **Marriage appears to be for immigration purposes only.** Sincerely,Chief, Immigrant Visa Unit

I need further advise as to what to do, who to call or who to notify before our case is sent back. Any assistance will be greately appreciated.

You can call the consulate to try and keep the petition there.

Or you can cancel the petition totally and refile with SO MUCH evidence in the initial submission that will decrease the chances of another 'immigration fraud' finding

However, once they suspect fraud, it is difficult to overocome

Lagos is an exceptionally difficult consulate to get approved from. Actually 'exceptionally difficult' is putting it kindly

Sorry to hear about the denial, I've been there and I feel your pain. First of, can you please let us know what questions they asked him and what his response was that lead to the suspicion/denial? Depending on the questions and and answers, you might be able or not, to appeal it. If it was a matter of submitting enough evidence, you might stand a chance. I believe calling the Lagos consulate for this is impossible. The only way to reach them is by email and since they have made their verdict, they'll just keep replying your email stating that your case is closed (But still email them and defend yourself). Contact your senate reps (all of them) and explain your situation to them. You would have to explain the reason for the denial and what lead to it so that your reps would know how to talk to them. Unfortunately, there is no guarantee that your senate reps would change their mind, but it is worth trying. Good luck.

Your husband should document the interview as best he can. What questions were asked and his answers , what they reviewed from his evidence. Are there any red flags in your relationship ? Large age difference , racial or religion difference. How many times did you visit before you married ? how did you meet ? were you married before ?

This will not be over quickly. You will not enjoy this.

You need a good lawyer who specializes in denials. Marc Ellis specializes in denials and I would recomend him as we appealed our CR1 denial and our case was reaffirmed. www.marcellislaw.com 713-893-7091 or 714-656-4156

You won't have much luck keeping your case at the embassy as it is probably on its way back. You need to be prepared for a long road. The only thing my senator was able to do was to get the USCIS to send our Notice of Intent to Revoke faster than it would of been done. You will need to wait on the Notice of Intent to Revoke, than appeal it. Good luck and email me if you have any questions.
