Haven't yet interviewed but our case has sent back to USCIS.We got NOA2 approved. I had my medical exam already and paid the visa fee but sadly petition needs to be sent back and no reason given. Fiance(e) called the NVC and USCIS and all they can give is to wait for 120 days and for further review.Please VJ members we need your help/advices on what to do in our case. Does senator representative can help expedite the process? Any VJ members have the same case as ours?Did you really wait for until 120 days?

Also, i have my police certificate from the country where i worked for and its been several months since i obtained it.Do i need to get new Police certificate even though i didn't go back to that country(UAE)? Anyway the validation of the police certificate is only three months:( and we are applying for k1 visa...

I would really appreciate all your answers.Thanks a lot!!

If your petition is back with USCIS then there will be a delay in getting to the Embassy and you will need to redo anything that expires because of the delay. That includes police certificates and if the delay is long enough your medical. If you don't have enough valid time on your medical your fiance visa may be issued for a shorter time or they may require a new medical. That is a risk when you do things ahead of time.

This will not be over quickly. You will not enjoy this.

Thank you for the reply:). Actually me and my fiance(e) received a letter confirming that i am eligible to have medical and can get appointment for an interview.After done both and paid the visa fee, my fiance(e) got a letter confirming that case has sent:( take note few more days and it would have my interview...grrrr. feel so sad about it... Now i guess another waiting time and need some redo:(... I am still hopeful though... I hope it wont take so long in USCIS...

Consulates accept police certificates for one year, regardless of what it says on the police certificate. Anything which expires, however, during this process will need to be renewed.

The consulate has discovered something with the petition which makes them think it is ineligible and should not have been approved. When this happens they send it back to USCIS with teir concerns. I do not know what that is, they will not tell you. USCIS reviews the petition and either will revoke it or will re-affirm it and send it back to the consulate and your consulate step begins again. Yes it can take 120 days or more. There is nothing your Senator or Congressman can do. You can call them and they can ask but they will not get any useful information.

It would not have mattered if you had your interview or not. There have been cases where people had the interview, got approved, had the visa in hand and then the visa was cancelled and the petition sent back and they were notified to return their passport to the consulate. Even if you had left for the USA they could deny you entry. It is not as if the timing would have made any difference. The petition and applications get reviewed many times by many eyes and anyone that discovers problems can simply cancel the whole process at any point even after you arrive in the USA. They can deny AOS and send you back, for example.

If there is some problem with your case, it needs to be sorted out and the sooner the better for you.

It rarely happens that cases are sent back before the interview, but it is not unheard of. As was mentioned, they suspect you are inelligible to receive a visa/ the petition should never have been approved. Often, the petitioner or beneficiary have a vague idea of what that might be. For example, are either of you divorced and it wasn't recorded properly? Did you recently return from the USA with a J1 visa which may have a home-stay requirement? Does the petitioner have sexual convictions? That sort of thing.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

New update!!

Our case was sent back because of name change..(actually we requested it)

The problem is ,last year,we got our NOA1 and NOA2 with an incomplete name of the beneficiary:( (in my G325a its complete but in the 129f it was not:(Case number, alien number birth date, everything is correct but only the benificiary's name wasnt written completely in NOA1 and NOA2

The information we got now is USCIS reviewed the case for name change but wasn't able to for no documentation:( now it is sent back to NVC:( We are too worried..:(.. we were hoping that they will sort out before sending it back to NVC/embassy:(

Plsssss help us what to do.... I would appreciate it any of your advice....
