Hello Everyone,

I just got married in Dominican Republic (11/06/2010) to the love of my life for the past 6 years. Initially I had petitioned him via fiance visa that was denied in Dominican Republic in March 2008. We were denied because we disagreed on some questions.

I am currently in the process of beginning petition for my husband form I-130. From what I have been able to research to begin this process I need to send forms: I-130, G-325A for him, & G-325A for myself, 2 passport style pictures of each us.

I have 2 questions:

Am I missing something?

On form I-130 there was a question: "HAVE YOU EVER BEFORE FILED A PETITION FOR THIS OR ANY OTHER ALIEN?" My answer: "MY HUSBAND DOMINICAN REPUBLIC 03/2008 VISA DENIED IN DOMINICAN REPUBLIC."

Any response or suggestions will be greatly appreciated.

Follow the guides and the check list in the link above

Congratuations on the marriage, however -marriage will not undo the K-1 denial. Especially if you 'disagreed' on some of the answers. Fix that first, then be prepared for a tougher interview.

Make sure you indicate that you did not file for your husband in the 1st petition but your fiance

The I-130 instructions and guides here are quite good at explaining what you need to send with the package. To study both very carefully will be critical to your eventual success. Yes, you are missing items from the list you'll find in those instructions.

On the question about previous filing, refer to him by "name" not relationship.

You posted in the K3 forum. The K3 visa is stopped being available almost a year ago. Please follow the CR1 Guide and post your later questions in that forum.

Could you please share with us a more detailed account of the bolded sentence?

Also, if you were denied in 2008, why did you wait until late 2010 to get married? I think this is a bit off. So, you should probably go ahead and explain this delay in your package, too, since it will probably be a question to enter the adjudicator and consul's minds.

August 23, 2010 - I-129 F package sent via USPS priority mail with delivery confirmation.

August 30, 2010 - Per Department of Homeland Security (DHS) e-mail, petition received and routed to California Service Center for processing. Check cashed. I-797C Notice of Action by mail (NOA 1) - Received date 08/25/2010. Notice date 08/27/2010.

After 150 days of imposed anxious patience...

January 24, 2011 - Per USCIS website, petition approved and notice mailed.

January 31, 2011 - Approval receipt notice (NOA 2) received by mail. Called NVC, given Santo Domingo case number, and informed that petition was sent same day to consulate.

Called Visa Specialist at the Department of State every day for a case update. Informed of interview date on February, 16 2011. Informed that packet was mailed to fiance on February, 15 2011.

February 21, 2011 - Fiance has not yet received packet. Called 1-877-804-5402 (Visa Information Center of the United States Embassy) to request a duplicate packet in person pick-up at the US consulate in Santo Domingo. Packet can be picked-up by fiance on 02/28.

March 1, 2011 - Medical exam completed at Consultorios de Visa in Santo Domingo.

March 9, 2011 at 6 AM - Interview, approved!

March 18, 2011 - POE together. JFK and O'Hare airports. Legal wedding: May 16, 2011.
