First of all, thank you for taking the time to read my post. I wasn't sure what forum to put this in but here it goes.............I am an American citizen and I married my Mexican wife in Mexico in August. She has to finish her last year of school while I am here working. We are going to file the i130 visa but we decided to wait until after Christmas so that she can visit without complications. Now that she is leaving Mexico on a bus to come here tomorrow, I am starting to get nervous if there will be any complications because we are married even though we have not filed the i130 visa yet. Is this a problem? What would be good advice for crossing the border in this situation? Of course I know to always be honest and I am not suggesting anything dishonest at all. Does it appear that we are married at the border? I was told before that her coming to visit would be no problem if we have not filed the visa but i just want to make sure. Any advice is appreciated, thank you.

I think you are looking for a reassurance of breaking the law so you are in the wrong forum. She is coming for you therefore she is breaking the law. Sometimes honesty is the best thing. convince me otherwise.

Visiting while married to a USC can be problematic. If questioned at the border she should never lie as it can come back as a misrepresentation and that brings a lifetime ban. If she s still in school she needs proof to show why she must return after her visit. Usually people married to USC have about a 50 50 chance of being turned away at the border even if they have a valid visitors visa.

She absolutely should not lie at the Border. If she is truly intending only to visit you her husband in the US that is perfectly fine and legal, but she will face the same scrutiny as any other visitor asking permission to visit the US. She is presumed to be an intended immigrant which puts the burden of proof on her. The fact that she is married to a USC strongly supports the legal presumption that she intends to overstay. Therefore, she should be well prepared to convince the agents at the border that she intends to return to her native country at the end of her permitted stay. This IMHO will require some very compelling proof of ties to her home country.
