Just filed Income tax return...we are married since November 2009.....PLEASE HELP ME ON WHAT THE IRS JUST HAVE TOLD MY HUSBAND!!!

My husband filed his Income tax return almost 2 weeks ago for the year 2009....his always on a short tour overseas thats why just filed his tax return...Our case is already at the NVC...My husband called the IRS to follow up and know the status of his tax return and a guy from there told him that his tax return might get rejected since he didnt put and i don't have the SSN....he told the guy from IRS that im here in the Philippines and processing my visa,and yet the guy told him that i have to get my SSN first...does anyone experienced this?my case is CR1 petition...Help me please fellas...should we call again and verify what the guy from IRS said...... :help:

The beneficiary will not get SSN in your case.

You need to send the tax return to IRS Austin, Texas address with completed W-7 and documents. Completed W-7 will process your ITIN (Individual Tax Identification Number).

If you need to know more about the process, let us know.

Also, this process can take around 8 weeks since it is paper based processing.

You need an SSN before your spouse can add you onto his tax return.

If you wish to be included as his beneficiary, then you need to submit an application for an ITIN (just as Loto mentioned) along with his tax return, so he may qualify for a refund.

+1 :thumbs: Yes, tax return should have been submitted with a form W7 for you. See here http://www.irs.gov/p...rs-pdf/p519.pdf for the IRS publication that covers your situation. You husband should consult with someone at the base legal office (it's free) in situations like this. Anyway, you want to pay special attention to pages 10 and 26, and once again the legal office is there to help out with anything he doesn't understand.

If the form is rejected just refile with the W7 and the "declaration of choice" letter and you should be fine. BTW, on the 1040, etc. just put "applied for" in the block where it asks for SSN/ITIN.

DISCLAIMER: :rofl: I only know all of this through my own recent research on the subject that came about because I'll be filing for myself and my own foreign spouse very soon.

thanks loto....you'r always to the rescue... :innocent: can i just scan the w-7 and email it to my husband??or it has to be the original w-7 form and send it to him on mail so he can mail it off...what about his pending tax return on IRS?I told my husband before that its ok if we cant get a refund for me as his dependent and thats what we did but he still put married but we didnt apply for ITIN...are u the petitioner loto?thanks again

It gets bit complicated in your case now.

W-7 signature must be original normally (for any govt. forms, they prefer original signature. They might accept scanned, but don't take any chance!). Also, I don't remember other supporting docs, I think notarized foreign passport copy of the beneficiary too.

Entire tax return must be submitted with W-7 and supporting docs. Address to mail is in W-7 instructions.

I don't know what will happen to your other IRS package already submitted, they will reject it for sure.

Just my two cents' worth: My accountant just had me file a straight tax form for last year instead of going through the chronicles of ITIN. Once my wife arrives (around the end of this year, yeah) and she is issued her SSN he will file an amended tax return. I had to agree with him that this seemed much easier and we are allowed 2 years to amend tax returns for this reason.
