Hello,

I petitioned for a K-1 Visa July 30, 2010. I listed my fiance son (who is 11 years old)on the I-129 as well as the 325 form. Am I supposed to petition any additional paperwork for him? I sure hope I havent delayed the process even more.

No, you don't petition for him. Your fiancee will apply for a K-2 visa for him at the Consulate in Colombia when she applies for her K-1.

My Immigration Journey:

He's a derivative. This means if your petition is approved then he's also eligible to apply for a visa. His eligibility is derived from your fiancee's eligibility.

The consulate may require you to submit a separate affidavit of support for him, but nothing extra is required at the petition stage. Listing him on the I-129F informs USCIS and the consulate that you are aware he exists, and that he's eligible to apply for a visa.

05/01/2013 - Removal of Conditions - APPROVED!
