I am at the point where my wife had her interview and then they requested more documents,..,like my ex wifes name and address and stuff,...taxes..again..but now we got another letter back saying I still need a co-sponsor,.,.,i make 20800.00 a year...the poverty level is 18212.00.....why do they say I need a co-sponsor,,,,any help would be welcomed....hoopy....wife is in china,,,,

Many times the Interview Officer will ask for a co sponsor when the income is not much over the minimum, even if you have income over the minimum for 3 years, and include assets. At our Dec 09 Interview, the Interview Officer mentioned that my income was low, even with 2 houses, good IRA accounts, and rental income. So for this second attempt, we have a co sponsor. The government poverty level posted is only a guide for the Visa process, and the Interview Officer has the final say. A steady $25,000 income is very good in some parts of the US, but is not so good in some parts of the US. Good luck.

What I feel is - Did you file "married filing jointly" taxes with your ex-wife last year? If yes, they need your W2/1099 with 1040 and schedules separately rather than IRS tax transcripts to separate your income out.

What I feel is - Did you file "married filing jointly" taxes with your ex-wife last year? If yes, they need your W2/1099 with 1040 and schedules separately rather than IRS tax transcripts to separate your income out.

well i didnt file married or jointly becasue she is still in china and i couldnt file that way..so i have also seen that you can file a case of hardship if your wife cany get a visa with the attorney general..oe do you have any advice because im not sure i can get a co sponsor...thanks

Well no I have been divorced 5 yrs as of now to my first wife,....so i had no reason to file with her...hoopy

Also can anyone tell me what I can do if my congressman cant help me with making them see i make enough money....is there any way to get around this need for a co-sponsor as I do make enough to support my wife,,,any info will be welcomed,,,thanks to all.,,Hoopy

Do you meet the poverty line of $18,212 for the current year and just the last year?

First, there's no US Embassy in Guangzhou. You're dealing with a Consulate.

Second, the poverty level is a guideline, not a goal line. Even as a guideline, the income must be properly documented. If you have a current employer letter showing your "employment income" is over the guideline for your family size and that's backed up with a tax return or three, that's a good thing but not a guarantee. Please provide more details.

It looks like your 2009 income is lower than the poverty line (worked only 3 months).

Current year income is just above the poverty line.

Now, you need a joint sponsor, as pushb said.

I think somebody 'confidently' said (don't remember the name), the current year income is enough and past year income is not needed. This is the best example for them. If one just passed the poverty line for the current year, last year income also has the weight.

Friends of mine got a blue slip a few months ago at Guangzhou, because the Interview Officer felt their income was not enough, even though they were well over the minimum. My friend lives in Calif. so I can see the Interview Officer's thinking on that. I could not afford the house taxes he pays. Congressmen can not help. The final decision is all up to the desretion (personal opinion) of the Interview Officer. Sorry, but that is just the way it is. To be on the safe side, just get a joint sponsor. :yes:

If your mom is LPR/USC, definitely yes. There is no upper age limit. Min age of sponsor or joint sponsor must be 18 years old. Also, your mom must be domiciled in the U.S.

If your mom lives at your (sponsor's) address, she will file I-864A and you will file I-864. Yours and her income can be combined in this case.

If your mom lives at different address, she will file I-864 and you will file I-864. Yours and her income can NOT be combined and she herself must overcome the entire poverty line threshold of the household.

If your mom is LPR/USC, definitely yes. There is no upper age limit. Min age of sponsor or joint sponsor must be 18 years old. Also, your mom must be domiciled in the U.S.

well my mom does live at the same address and her income is 14,000.00 a year and mine is 20,800.00 per year...do you think this will satisfy the interview guy in guanzhou...my wife had her interview already and this seems to be the only thing holding up the visa..any advise is welcomed..thanks...hoopy
