Hi all, a friend of ours is married to a US citizen. She has a conditional green card (2yr) and looks like her husband has been cheating on her and now wants to divorce her just before their 2 year green card expires. Will she be forced to leave the country? Does the USCIS send her a letter that gives her a deadline to leave the country by?

Any advice would help, I am not sure what to tell her. I am almost positive her husband is divorcing her on purpose before the 2yr deadline just to make sure she can't even continue staying here.

Thanks in advance!

As you found, she doesn't need to leave the country if she can prove the marriage was entered into in good faith and files ROC with a good faith waiver in the 90 days before her 2 year card expires. She should try and get the divorce finalised ASAP because she'll need the decree to successfully ROC. She can file ROC without it (because she HAS to file in the 90 days before her card expires) but she'll need it to get approved.

** moved from "Adjustment of Status (Green Card) from Family Based Visas" to Effects of Major Family Changes on Immigration Benefits as this is a more appropriate location**
