Hi all, I hope this is the correct place to post this. I have a few questions...First my fiance is from Japan, we have been dating over webcam for a year and a half. He tried to get a tourist visa about six months ago and was denied because he got in a few fights when he was 21 (he is now 29)seems silly to me but ok. So last month we met in Mexico for 3 weeks, it was amazing! I know alot of you will agree that it is crazy to find that one person that makes you so happy and they live half way around the world! Anyway my question is which visa should we try fiance or spouse with his situation I want to go with the one that will get him here first and the quicker one also. And if we apply for the fiance visa can we still meet during the process? It will be in Costa Rica. Thank you in advance for your help.

K-1 is the quickest option. You fill just need to show that you two have met at least once in the past 2 years (which you have) and that you are both available to marry. While it is in process you are able to visit one another provided that you can get a visa to wherever you are going to.

K-3 is dead, it was administratively closed earlier this year.

The K-1 is slightly faster than the Cr-1 spousal visa; however it is almost twice as expensive and does not allow for immediate work or travel once in the US - the CR1- does. So if working and traveling aren't important to you, then go for the quicker k_1
