Timeline

My fiance is coming for a visit in October. Can she be present in the country when we file the petition for her visa?...we are gonna file when she comes (she is going back to england in November)...

According to what I've in another thread, you could get married and adjust her status while she is here because your intent was not to get married when she applied for the visa. This will allow you to skip over a lot of the drama the majority of folks here are facing. Of course that's if you wanted too or are ready to do that. However, I'm just writting what I read and you would have to check on whether that would be an option for you. As you may know, you will not have any problems going through the K1 process and obtaining a visa through the Embassy in England, despite of the chaos with the Service Centers. Good luck...

Proof of the phrase that a little knowledge is dangerous.

For a start she does not need a Visa to enter the US, she is English.

Goes downhill from there.

Alright, let's get things straight. I assumed the OP would file for K1 while his/her fiance was in the U.S. and that the fiance would then fly back to the U.K. I also assumed the fiance is not currently in the U.S. But, yeah, too many assumptions and I see now that the information I provided totally sucked. Sorry about that. :blush:

I am currentlyin the US and we filed from here. I'm visiting for as long as the law will allow. Be careful of just marrying 'spontaneously' if your UK fiance has already begun to put stuff in order to leave permanently. I don't know what is involved in that process (or marrying on the spur of the moment and then adjusting status) but it seemed like a risky thing to do when we were researching all options. I don't know what kind of proof they need that the marriage was indeed spontaneous (if any proof at all).

Good luck. Best advice I have is to do all your homework and then file ASAP.. the process is long enough as it is.

Sept 16 - NOA1s received

2014

Feb 25 - got emails saying that the cases had been transferred to another office for processing

Feb 26 - got emails saying that the cases have been transferred to my local office for processing

Feb 28 - got emails saying that the cases have been transferred and are being processed

Mar 17 - got email, attached to one case number only, saying that my A number was changed relating to the I-130 filing

Mar 18 - got emails saying that the petitions are approved smile.png
