No it doesn't say he is in removal proceedings, just that he never filed and his status has been revoked. He does hold some responsibility too, but he has been so busy trying to keep the money coming in to pay the medical bills, and helping me, that I'm sure he never even realized.

Just found all my bils, my discharge papers from the mental health center, my paperwork for my disability hearing that is coming in January, letters from our insurance company and such. Going to make copies and send all that as well.

You have GOT to get yourselves legal representation now - this falls outside the realm of what most VJers can help you with. Catholic Charities can provide immigration legal assistance at little to no cost - google it. They may well tell you to file now anyway but there are likely a whole host of landmines awaiting you - as now you're fighting his revoked status with possible removal in the off.

Actually the guy at USCIS said to file it immediately, which is what I am doing. I thought it was pretty much understood that when they send you a letter saying you didn't file, that's what they do...revoke your status. Then they send you a letter stating you need to appear before a judge. Thanks for the idea of Catholic Charities...I will give them a call.

Taking advice from 'the guy' at USCIS is always a potential disaster. The tier 1 operators just read from scripts and know little to nothing about actual immigration issues/processes and procedures. Unless you went to a tier 2 operator or an Infopass appointment.

Either way - I would at least have a consultation with an immigration attorney before I did anything.

Sorry for all you are going through. I do agree that this is his responsibility as its his GC and especially with everything you are going through medically.

You said that the letter stated "status has been revoked"? Doesn't that mean his temporary GC status revoked = no status? Correct me if i am wrong but you may want to at least "consult" an attorney before sending that out. I wasn't able to cut and paste but if you look at the I 751 Instructions paragraph 3 it states "you will automically lose your permanant residence". I guess what i am trying to get at it that as soon as you file this you should be prepared that he may get removed as he has been "out of status" for quite a few months now so you may want to research some legal help if you can.

Sending this in this late will remind them that he is still here with no status.

I understand the predicament you're in, but this is serious. Depending on your next move, your husband will be able to stay with you, or will have to return to England with a bar attached that will cause more headaches and attorney costs as you can possibly imagine.

But maybe you can imagine being in a court room, in front of a judge, and you have one shot to plead your case. If so, you better make sure you give it your best shot. For that very reason you should prepare a superb letter that is structurally sound and may help you to get a late ROC approved, something that after such a long time is rather unlikely. You definitely need a huge package of medical bills and most likely you need an experienced immigration attorney writing the letter for you. There are times where you need professional help, and this is one of these times. Get more in debt if you have to, but take this as serious as it really is.

I am sorry for your circumstances...as the beneficiary, I remembered exactly when I had to mail in my app to remove conditions when I got my Conditional GC. Your husbands employment is based on his status, which he no longer has therefore, he is working illegally. I hope & pray that no one checks his employee file. Also, he should have only a temp drivers license based on his status as well...I know I have to mail in the extension letter to the DMV along with copies of my passport, etc. No drivers license = no insurance. Make sure you make triple copies of everything you send as I'm sure this application will mean an interview. You have been ill and yes, he's been busy BUT he should have known better...if he loses his job due to being here illegally, I'd hate to think what would happen to you financially and physically! Make sure HE sends in absolutely everything possible and HE writes the best letter of his life! Good luck to both of you!

I can imagine being in court. I actually would welcome the chance to plead our case. What annoys me to no end, is up till now we have done everything right. And now do to circumstances, he could be kicked out, but people that come here illegally and stay and commit crimes are still here. I plan on being very vocal about this if it goes badly....newspapers, my senator, local news channel.

I understand your frustration - and a lot of things were going on at the time in your personal life where this took a back burner. But it is still his responsibility to maintain his permanent residency - regardless of what they do (or don't do) with illegal immigrants. There are few things GC holders must to do maintain their legal status in this country, and removing conditions is one of them (for those who are initially issued 2 year GCs). I didn't think that was too much to ask to keep my husband here.

Man sorry to hear that. I will suggest you wait and get all your medical records and send them with the explanation. It will make for a stronger arguement on your behalf than to send next to nothing besides an explanation letter. They will want to see proof of the reason being late. It is sad what you've been through but stuff happenes in life and the people at USCIS are very much aware of that so don't lose sleep over this. It is what it is. Get as much proof of your circumstances and whoever gets your file most definitely has a heart beating in their chest and will see to it that you get approved considering that you've been to hell and back. Good luck and keep us posted. Hopefully we will be reading about an approval from you in the near future.
